The Battle at Carmichaels Farm- A battle for Justice

The decision against laying charges in this Animal cruelty case is yet another nail in the tombstone of Rural Canada. It is evident that our governments run rampant over individual rural people and farmers; and face no judgment for their actions.

Under the dark robes of secrecy, Crown Attorney Curt Flanagan has decided that silence is the only remedy for this crime. He is employed by the taxpayers to serve the publics' interest, but has taken justice upon himself and refuses to answer for his conduct. Mr. Flanagan has declared himself judge, jury, and the exclusive arbiter between good and evil, without regard for democracy. These unjust actions require scrutiny and public disclosure of the facts and evidence.

Dr. Martin Luther Kings’ phrase "A Time Comes When Silence Is Betrayal" is borne true by the actions of crown attorney Curt Flanagan.

After repeated questioning Curt Flanagan refused to acknowledge whether he has received or read the 25 eye-witness accounts to the events of March 23, 2006. Furthermore, he refuses to acknowledge if he has passed a legal opinion with respect to the allegations of animal cruelty charges. Are these actions not contempt towards Canadian people? Is it not a betrayal of openness, transparency, and an abuse of powers? No matter what robe is worn by the offenders, injustice cannot ever be tolerated nor acceptable.

It is evident that when agencies of the government break the law, the crown refuses to find the will or motivation to uphold justice.

Rural landowners charge Curt Flanagan with contempt for the people, and obstruction of justice, and summon Curt Flanagan to testify before the people and answer these charges.

The landowners further charge OPP Constable Jennifer Cassidy and OSPCA inspector Connie Mallory with aiding and abetting crown attorney Flanagan in his silence and summon them to the Brockville court house on August 29 to answer these allegations. We further demand and call upon the OPP and OSPCA to make their reports public on August 29.

Landowners will be present at Carmichael’s trial in Brockville on August 29, but it will not only be Shawn Carmichael who will stand on trial.


Background

On March 23rd 2006, hundreds of chickens were dehydrated, starved, suffocated to death at the hands of officials from government agencies. Professional chicken packer hired by Egg Farmers of Ontario (EFO) packed more than 15 large birds into small cages, crammed so tight that the doors could barely be opened to release the birds. Wings and legs were broken and twisted as could be seen from the many pictures that were taken. Officials from the Canadian Food Inspection Agency (CFIA), the enforcers of the Transport of Animals regulations; stood by and silently observed the chickens dying, doing nothing while their mandated regulations were being broken. The Ontario Society for Prevention of Cruelty to Animals (OSPCA) officials were called to the farm to stop the cruelty, but refused to answer the call, as “the CFIA knew what they were doing.”

The farmer, Shawn Carmichael, and Landowners from the OLA and LGLA requested that the sides be removed from the trailer where the birds were being loaded for better ventilation. This request was denied. At the end of the day, the Landowners rescued the animals but hundreds had perished.
