Sunray, it's already been established flare guns aren't firearms. Having also spoke with CFC techs and Customs officials and Canadian firearms importers, flare launchers aren't exactly that easy to import under the title "flare gun". Prohibited Weapons Order #1 is the primary reason Customs uses to disallow importation, and symantics (as in could be used for discharging gas canisters where at least some of the launchers have the word "gas" stamped on the side) is the primary focus. Lots of illegal stuff can be loaded in shotguns too, and that doesn't make the shotgun illegal, but Customs has their policy and in law (eg :- prohibited weapons order #1) words mean everything. Challenging the policy or even an individual Customs agent's "feelings" where the launcher should be classified will require a lot of peripherial proof the item will fire flares only and not intended to fire destructive cartridges hence making it the prohibited device.
