Win 94 lever safety pin issue?

I recently bought a win 94 pre 64 3030 and took it to the range yesterday.
When operating the lever , it rides by the safety pin and won’t function.
I think the problem is that that the area of the lever that depresses the safety pin is worn and combined with the side play in the lever ,caus s it to ride past .
So, would you say that should have been disclosed by the seller?
I personally don’t see how it could’ve been missed, unless the seller never fired it.
Would you let it slide?

It might be an optical illusion caused by the angle of the photo, but it looks like your lever is bent. The notch on the bottom looks like a deliberate modification, not just wear.

The notch is repairable, but it should have been disclosed.

It’s not bent, the lever is just pushed to the side, it bounces off that indent( worn area) and slides right past the safety pin.
Lever has more sideways movement one way

Replace the lever. Contact the seller, ask them to compensate you for the cost. No guarantee they will.

That's why I prefer Marlins nice and tight 94's rattle traps
That being said my guess is the seller new about the issue many sellers seem to think that non discloser makes them non liable not sure how that plays out .
I also know that in a court of law buying used is buyer beware

By the serial number what year was it built. The last few years of pre 64 94s were very very sloppy that's why they got all new machinery to make them.

Well the reply was that the old Winchesters are sloppy to begin with.

Very easy fix. get the notch tig welded with filler and reduce spring tension on that trigger lock out
the spring tension only needs to be enough to hold the lock-out lever down with very little pressure. No need for a lock-out that requires you to turn your fingers white from effort to overcome when squeezing the lever.

Looks like a lot of wear for just basic use. More going on in that rifles history IMO. Win 94's are sloppy, but not that sloppy. I would start by removing the lever and check for flatness first. If bent, replacing it is the simplest fix. Repairing it is more involved and likely involve refinishing.
Good used levers are around.

I went through a bit of messing around to get a pre 64, but had enough headache now .. lol
So I bought a new 94 yesterday.
I’ll try another lever , if it works I’ll throw it up on the EE, I’ll take a loss but that’s the way she goes sometimes
