Does my pump shotgun really have to have a magazine limited to two shells in BC?

Here is section 26 of the BC Wildlife Act: Does subsection (h) say what I think it does? (plugged to 2 rounds?)


Hunting, trapping and firearm prohibitions
26 (1) A person commits an offence if the person hunts, takes, traps, wounds or kills wildlife

(a) that is an endangered species or threatened species,
(b) in a wildlife sanctuary,
(c) at a time not within the open season,
(d) with a firearm or a bow during the prohibited hours,
(e) by the use or with the aid of a light or illuminating device,
(f) with poison,
(g) with a set gun, or
(h) with a pump, repeating or auto loading shotgun unless the magazine contains a plug that is incapable of removal except by disassembling the gun, and that makes the magazine incapable of holding more than 2 cartridges.
(2) Subsection (1) (c), (d), (e) and (h) does not apply to a person who hunts or traps wildlife that is on the person's property and is a menace to a domestic animal or bird.

If you are hunting with it, yes.
If you are using for nuisance control or just shooting casual clays/targets/ plinking(is it still plinking if you are using a shotgun?) you can be unplugged.
 
I thought it was only for migratory birds as well, but I thought the rule was plugged to 3 rounds.
I was completely unaware we had a 2 shell mag limit for any shotgun hunting in BC . Please someone tell me I'm reading ths incorectly.

I think this is only for birds...
 
Not only for birds, any hunting with "shot" in BC the magazine must be limited to 2.

For slugs you can pull the plug, also for target shooting.
 
Mag plugged to 2 and one in the chamber gives you the 3 you're thinking of
Could be for birds as far as that goes I'm in Alberta and don't really thing of hunting anything but birds (and possibly the occasional coyote) with a shotgun.

Now, DarkW what is it you are trying to do?
Are you actually hunting or are you out in the bush shooting popcans and such?
Just because you are shooting popcans in a gravel pit and there might be a Legal Big Game Season or any Game Animal Season available to Legally Licensed Hunters does not mean that an over zealous CO will not charge you or attempt to charge you with failure to produce a Hunting Lic.

Shotgun use in BC, broken down.....

1. Hunting with a shotgun and using SHOT? Mag plugged to 2 rounds

2. Hunting with a shotgun and using SLUGS? No mag limit

3. Not hunting? Using the shotgun for defense or target shooting? No plug required, regardless of ammunition type
 
DarkW, what is it you are trying to hunt with your shotgun?
Again, there are some finely printed restrictions and it would help those in the know where to look and offer some more knowledgeable advice.
Specifically, what gauge of gun are you planning to use and what Game Animal of choice are you thinking of?
23 days till most Game Seasons local to me begin to open ;)

I think the 3 shell limit for shotgun hunting is pretty much universal.

Each province is different.
-Some require the total 3 shot limit for migratory only.
-Others apply this to upland bird species too, but this is not universal. IIRC, Nova Scotia does not have this limit for upland bird.
-Ontario puts the 3 total shot limit to big game hunting with slugs too. But many western provinces do not have this same regulation.

All of North America requires a 3 shot limit for migratory game birds.
 
I just found it on page 17 of the Hunting Regs Synopsis. Mag limit is two for hunting with shot shell and unplugged for slugs, just as Drillbit says. I'll be danged. Learn something new every year.

Remember, the synopsis is not the Act. The Act says:

Am I missing where, in the Act, it makes a distinction between "shot" and "slugs"? Maybe it's there but S.26 looks pretty black and white. Just because it's in the synopsis doesn't mean anything. It has to be in the Act.
