Hi Guys

My question reiterates the title of my post. Is hunting with lead shot banned for waterfowl all across Canada? How about North America? Do most states ban the use of lead shot? Furthermore, is it allowed for game birds in Canada and the United-States?

Thanks

Lewis

Yes and yes! The U.S was on a non-toxic mandate years before Canada was. Read your regs closely. Even though woodcock are an upland bird in the hunting sense they are a Migratory Bird that falls within the framework of The Migratory Birds Act and you are not allowed to hunt ANY bird classified as Migratory with anything other than approved non-toxic shot whether you are hunting dry land, over water or marsh, bush etc.

Not quite so. Woodcock can be hunted using lead and if we're splitting hairs, then the mourning dove is another I can think of where lead shot can be used.

I just read it a couple weeks ago on Environment Canada's website, so here was my chance at a "Cliff Claven" moment. :)

Well ya see, The Spank, it's like this. A flock of timberdoodle can only move as fast as the slowest timberdoodle . And when the flock is hunted, it is the slowest and weakest ones at the back that are killed first. This natural selection is good for the flock as a whole, because the general speed and health of the whole group keeps improving by the regular killing of the weakest members. In much the same way, the human brain can only operate as fast as the slowest brain cells. Excessive intake of alcohol, as we know, kills brain cells. But naturally, it attacks the slowest and weakest brain cells first. In this way, regular consumption of beer eliminates the weaker brain cells, making the brain a faster and more efficient machine. That's why you always feel smarter after a few beers.

That is not true. You cannot hunt doves with lead shot, at least in Ontario. I can't speak for the other provinces. This is the exact wording from the Migratory Bird Regs for Ontaio.

"In Ontario, non-toxic shot must be used to hunt all migratory game birds, except for woodcock"

True, use of non-tox applies to Dove hunting as well even though it doesn't make much sense.

And as quickly as that moment came... It is sadly gone again :p

For informational purposes we all know that each province manages it's own wild game and correct me if I'm wrong but i believe each state manages it's own wild game. Therefore there would be a law for each province and state. But is there a ban of shot for both countries?

The Migratory Birds Convention Act, 1994 is federal, and a convention reached between Canada and the United States.

The prohibition against lead shot is set out in the Migratory Birds Regulations, e.g.:

15.1 (1) Subject to subsection (2), no person shall
(a) possess, for the purpose of hunting a migratory game bird, except a woodcock, band-tailed pigeon or mourning dove, shot other than non-toxic shot; or
(b) hunt a migratory game bird, except a woodcock, band-tailed pigeon or mourning dove, by the use of shot other than non-toxic shot.
(2) The exceptions of woodcock, band-tailed pigeon and mourning dove set out in subsection (1) do not apply in
(a) any area in which the use of non-toxic shot is required under Schedule I when hunting those species; and
(b) the wildlife areas set out in Schedule I to the Wildlife Area Regulations.

As CV32 said there is an agreement between Canada and the USA regarding lead shot and its use on migratory game.
As a point of information, each province and state has its own laws regarding shot. I know that in my home province of New Brunswick we're required to use use non-toxic for all hunting in conservation areas. Rifles are exempt I believe, I'd have to double check. Lead shot is allowed for upland game on public and private land.

Edit: woops I was wrong down below.

******I would recommend you read the regs because unless it is a misprint, the regulations don't agree with you. You must use non toxic shot for all migratory game.
