Versamax Tactical magazine capacity

So, legally they can hold 5 x 3in shells, but mine only holds 4? I can back out the mag tube a bit, but it wobbles unless I've got the mag tube clamp installed, is that normal or should the back tube be fully threaded in and it's only supposed to hold 4 x 3in shells?

How many times do people need to say it's legal as long as it holds maximum of 5 rounds of the maximum marked chamber size?
