Is the chambering in a shotgun based on the action?

If I have a 3.5" actioned semi with a 3" chambered barrel, can I still have a mag tube that holds 5-3.5" shells? I'm referring to the Beretta 1301 comp.

Don't expect a straight answer. Or a straight answer that legally correct and binding.

Read the FA. Mags are the controlled item, whether fixed or detachable. Chambering and mag capacity are not tied together in the FA.
 
You're playing with something that could easily go either way in court.

Be aware of what you're risking for that one extra shell. Decide for yourself if it's worth the risk.

True. But following the law is no guarantee of not ending up in court these days either.

The purpose of this bulletin is to provide greater clarity on the maximum permitted capacity of cartridge magazines designed or manufactured for use in more than one kind of firearm. Note that the maximum permitted capacity of a magazine is determined by the physical characteristics of the firearm it is designed or manufactured for and the type of ammunition for which it is designed. The maximum permitted capacity of the magazine does not depend on the classification of the firearm, nor does the magazine capacity influence the classification of the firearm.

Just as the use of a Beowulf mag capable of holding 13-14 .223 rounds in a AR type rifle, its what the magazine is "designed " for , not what you can stuff into it. I wish all shot guns were 3 1/2".
 
I called the cfc about this. They transferred me to the firearms identification tech. He said send the question in an email they would get back to me. It's been about 4 weeks with no reply. My question was similar. I asked if I have a versamax with two barrels one marked 3.5 and one marked 3 does the mag tube depend on the barrel attached or go by the reciever.
 
I think it's obvious that in order to call it a 3.5" shotgun, it needs to actually be able to shoot 3.5" ammo.

If it can't, then it isn't.
 
The thing is it can shoot 3.5" shells if I have my duck barrel on it. The law isn't clear about switching back and forth. When using the tactical 3" barrel does the mag tube have to be altered permanently? Seems like a grey area and I doubt the firearms centre will answer on it.
 
Beretta's add states the 1301 comp is their 3.5" action to allow for a larger loading port. The barrel is a 3". I'm thinking since the magazine is attached to the receiver, it should hold 5-3.5" shells. That's where my question came from.
 
I wouldn't want to be the guy trying to convince a judge that my shotgun is 3.5", when it can't fire 3.5" shells.

You'd need to be a hell of a salesman to pull that off.
