In most cases this is not criminal as it is information used to send you junk mail, find out your likes preferences, etc., so that they can email you junk that you may be interested in buying based on your web tracking and interests. Android tablets are a little more susceptible to this than Apple devices, as with Apple, all programs must be screened before they are put on the 'app store". Android however, is open sourced and much more open to malicious malware threats, but you can get anti-virus programs for them which can semi-protect you against unwanted or malicious malware.
