Savage .308 Feeding Problems

So took my new savage 16/116 FCSS in .308 out to the range for the first time today and I am having feeding problems. Here are the details:

-only happens on them second and fourth loaded round (fourth not as much as second)
-doesn't matter if I go slow with the bolt or fast
-round seems to have its back side pop up out of the action and prevent the bolt from pushing it in

I have only put 20rounds down range (shooting 150 Federal Power Shok) however I tried probably 40 cycles of the bolt and it jams on the second loaded round 40-50% of the time.

Anyone else have this problem? I'm curious if it's a magazine issue, something that fixes itself during break in or if it's ammo related.

Smarter people than me will comment soon, but in the meantime, I assume it is a stagger box magazine and the fact that it is the second and the fourth round could the feed ramp have a problem on that side or is it hanging up on the front inside the magazine, also when you are loading are you pushing the rounds all the way to the back of the magazine. My recollection of the Savage magazine is that it came apart quite easy maybe compare the way the Follower spring is with a schematic drawing
 
How does stuff like this get past quality control? Isn't there some stage in the factory process where function is checked?

I think they are pumping out more rifles then they can properly QC...there was a whole batch of the Model 10 LE or whatever they call it with bores so off axis you couldn't zero them.
 
I'm very disappointed in it since the rifle is wicked accurate.
Action is still a little rough but it is already loosening up since I got it.

Going to call savage customer support and see what they recommend.
Bought the rifle since I loved my savage .22s so much, if I find a solution to the problem I'll post it for future reference. If anyone else hasn't details please share your knowledge.
