too bad no one takes the rcmp to court on this. i would have them bring that firearm they have deemed convertible to full automatic to court and ask them to convert it in court right there. they will have to say they can't because they don't have the parts. then my rebuttal would be how as a gun owner can i "readily" convert this firearm if i can not buy or be in possession of these parts and i cannot import them. would that not mean "readily" is a moot point in this case. problem is a liberal judge would come up with some lame reason to discredit this even if it didn't apply.

OP, while I appreciate your candor, unless you are wealthy, the first consideration of such an action should be the fact that you are going up against the state in such matters.

Their pocketbook is bottomless, padded comfortably with YOUR tax dollars. They can drag these issues on FOREVER & use abusive delay tactics in court, to increase the financial pain.

Many in the firearms community have been ruined by court actions that many of us see as purely abusive of 'law' & process, resulting in financial hardship for the individual that dares to challenge the state. Case in point, Ian Thompson. I contributed TWICE to his legal fund through his lawyer Ed Burlew. The community rallied around Ian, yet he was still left with a HUGE bill. I still lament the loss of opportunity for the community to send a message to the Crown, one where the community paid off the debt & essentially told the Crown we will not stand for such abuse. But I digress.

Hence the first two long time members here 'encouraging' you to step up to the plate... (And I am sure they did so 'tongue in cheek', heavily laden with sarcasm because they know what I described to you above, is exactly how this would all play out.)

It has happened. There was a demonstration in court of conversion of a firearm which had been deemed to be prohibited on basis of ease of conversion.
Some of the ones deemed easily convertible were, in fact, easily convertible. Some pathetically so.

The law does not mention ease of conversion. Under the law, a firearm is either full auto or it is not. The Supreme Court of Canada has ruled that a firearm which is easily convertible to full auto is considered to be full auto.

OP - the RCMP's SFSS is secretive about how firearms may be easily converted to full auto - public safety, you know. Having said that, if there is a court hearing, they will explain the process in court.

You can buy full auto parts there not regulated. You have no argument.
 
Remember for the State is about Control Not Safety

Our laws concerning firearms and methods of which crimes are performed make no sense. Laws should be simple

Murder, Assault, kidnapping, robbery etc are all Illegal and to my knowledge have always be illegal in some form in Canada. Who cares if you use a gun , knife or the bane of airlines nail clippers to commit the act.
 
I heard of a case where exactly that happened. The owner of the firearm took the RCMP to court, protesting that his firearm was not "readily" convertible to full auto. To make a long story short, given 2 experts (one for the defense and one for the crown), the judge chose to side with the RCMP "expert", and the gentleman lost the case AND was out a big whack of cash as well as his firearm. If you win (or I win) a lottery, I would put cash aside to challenge such rulings. Alas, unless your pockets are as deep as the crowns, the deck is seriously stacked against you.
 
I suppose it depends on what is considered easy. That will be different for different people. A machinist would "easily" be able to convert an SKS to full auto. In fact, I don't think I would have a hard time doing it either if I had the right equipment.

The SKS is a bit of an enigma in this country. And you're right... They're not difficult to convert if you're half assed handy. Not that I ever would... But it has certainly been done.

The SCoC precedent on easily converted does not provide for machine shops or sophisticated reworks.
This is why there have not been a multitude of new prohibitions.

That's weird cuz lots of part kits for vz58 that have came to Canada have had auto sears and auto disconnecters in them. Show me the law stating that.

There are specific auto converters that are illegal - like the "Lightning Link". It is a drop-in unit. Otherwise, gun parts are just gun parts, as far as possession is concerned. There are a lot of ARs which have selective fire bolt carriers, for example, and these are regularly imported and resold.

Exactly, I have a full auto bcg in my ar just like most other ppl, does my gun go full auto.... no
