Somebody has to take the plunge and be the first to submit a receiver or finished rifle to the lab for classification. Based on what happened with the HK 243 (civilian G36) already being declared prohib by the lab, I wouldn't be overly hopeful. Furthermore, seeking a new or "child" FRT entry for Bostic's receiver could trigger a re-evaluation of the existing FRT for the handful of semi-auto G36s floating around in Canada, royally annoying their owners if a prohibition is the outcome. The "reward" in this case is probably not worth the risk of a blanket prohibition.
Polskadude is the resident G36 expert on here, so I will let him chime in with more detail. The bottom line is that when this very same possibility was raised several months ago, it was explained in no uncertain terms to me why this might be a very bad idea. FWIW....
I have to disagree sir. Instead of a re-evaluation they can use the existing g36 frt and sell it as one. Especially if Hk gives them a license or doesn't sue tom bostic

Anyway, I built a little G36 clone out of a SL8, I enjoyed it a lot and one of these receivers would be a lot better for a build. (instead of using the stock block) sadly we have to bow down to our overseers I guess lol
You cannot have the "T36" fall under the existing G36 FRT entry, as it is clearly not the exact same "firearm" as the latter. It is a T36, with as yet undetermined design aspects which may or may not permit the inclusion of genuine G36 select-fire components. That is precisely what the lab would want to confirm through examination of a T36 Receiver or a finished T36 rifle.
HK will not grant Tom Bostic a license, nor will they sue him. The patents have now expired on the G36, so the design is no longer solely HK's. This is the reason that the US company GSG9 is able to produce American made G36 parts currently for sale on the HKParts.net website.
