Does this look like a brand new scope?

I'd be returning that for sure. You can clearly see the ring marks from it being previously mounted.

Hopefully you make out dealing with them. If not you can always file a chargeback with your CC company.

Certainly looks to be used to me. I've got scopes on hunting rifles that have been used for years with less marks than that.
 
I too agree with ring mark rubs.
Whether it was used for hunting or shooting you won't know.
Could quite possibly be mounted on store inventory and taken off
resulting in those ring marks.

Can it be qualified as new?
Open box stock …………. maybe.

Next step: contact CC company, product not received as advertised.

Dec 18 until now, there's no excuse not to get a reply. I don't care if we've had Christmas and New Year, there have still been plenty of businesses days for them to reply.

There is a time frame as to credit card purchase complaints.
Best you call your cc company and request a review of this purchase.
Your ship, your bow, but that isn't brand spank'in new regardless as
to what the vendor states.

How did you contact the dealer?
Sent an email? Did they get it? Could it have been routed to their junk mail? Have you followed up?
Have you called them and spoken to a real live human being?
Until you have actually made contact, you don't know what the status is.

The email I sent was to their main office email, I just sent another to their "warranty" email address. We will see ...
 
As previously suggested, phone them.
I would get the name of the person that you are speaking to and ask them what will be done and when.

Some companies do not pay a lot of attention to emails.
