Warranty work in the USA - ITAR, Issues, Customs etc?

I plan on sending one of my scopes down to the USA for warranty work.

Assuming the paper work shows it is warranty will I / will I not have issues with the border / USA ITAR etc etc?
 
Check with the manufacturer before you send, they should know. I have sent SureFire infrared devices back to them before and got them back without issue, but Aimpoint had me send the optic back to Sweden because of export rules. If I recall correctly, I believe scopes are actually not ITAR as that is related to the Dept. of State, scopes are regulated by the Dept. of Commerce.

Pretty sure Dept of Commerce took over some of the ITAR stuff recently. Still need paperwork to import one. Wonder if the company doing the warranty ought to handle that?

Why isn't the dealer taking care of that for you?

I would NOT do that. Most rifle optics are definitely ITAR controlled. The law is pretty ambiguous about this and as more and more shooters prefer military style optics? That means less and less can make it through the non military exemptions granted under the US Munitions list. Also? Don't expect CBP to know the difference because most of their staff don't know or don't care. If you're caught on the U.S. side? Expect at least 5 years in federal prison. Get a Canadian business with an ITAR permit to do it for you.
