Supreme Court affirms American Indigenous man's right to hunt in Canada

OTTAWA — The Supreme Court of Canada says an American Indigenous man has a constitutionally protected right to hunt in British Columbia given his people's historic ties to the region.

The decision today comes in the case of Richard Lee Desautel, a U.S. citizen who was charged with hunting without a licence after shooting an elk near Castlegar, B.C.

Desautel defended his actions on the basis he had an Aboriginal right to hunt protected by section 35(1) of Canada's Constitution Act.

Desautel is a member of the Lakes Tribe of the Colville Confederated Tribes of Washington state, a successor of the Sinixt people, whose ancestral territory extended into B.C.

The trial judge found the sections of B.C.'s Wildlife Act under which Desautel was charged had infringed his constitutional right to hunt in the province.

The decision was upheld by the B.C. Supreme Court and the province's Court of Appeal, prompting the Crown to take its case to the Supreme Court of Canada.

I wonder if Mexicans or Mongolians will be next to be granted treaty rights in Canada after all their ancestry can be traced showing migration here too.

So, should we give most of Europe back to the Germany? Most of norther Europe was first inhabited by Germanic tribes...all the way back to the Corded Ware culture 2900 BCE – circa 2350 BCE
 
Let him hunt, no modern food, Tabaco, liquor or modern clothing, no modern weapons, no modern form of transport, everything he needs to come hunting and to hunt must be as it would have been before the evil white man showed up. I believe this even includes horses as they were introduced by the Spanish ( could be wrong on this)
 
That BS about feeding..they just have to go to the grocery store like all of us. We are in 2021 now.

So they were no guns restriction in 1680 in Canada..so it mean all those guns laws are not valid since our ancestors did not have any ?
 
I guess he could go hunting at the zoo, there were no zoo's during the time of his ancestors, therefore the fences and paddock could be viewed as non existent. Mite as well come to Abbotsford and bag a giraffe.
 
And once again modern science tells us we all originated from the same species. At the end of the day 'OUR' ancestors originally settled here thousands of years ago and 'OUR' ancestors came across the pond sometime later to join up with their lost family members. Like all family's there was some feuding going on but hey, we're family so get over it! Equal rights for everyone. It's inevitable.

Speaking of lots of ignorance on this topic... Shortest history lesson you'll ever get. 150 years ago there were two kinds of people conquerors and vanquished... You were one or the other... There were no participation medals.
Guess who got their asses handed to them... And guess who was the Conqueror?
The fact that some folks got treated extremely well considering... Well, just cash that check and enjoy it... But let's lay off with the This Is Our Land? If you could have made them take a dirt nap or pushed the devils back into the surf and left them floating... you would have.
 
I would like to see what would happen if the nation's were reversed. You could bet your ass the Americans would probably gitmo a Canadian coming over the border to do this.
