A picture paints a thousand words. I should have done this earlier but here's a pic of a .44 Russian and a .44-40 against each other. The difference in cylinder length is obvious. Also, here's a pic of the chambers. You'll note a sort of halo just behind the case mouth stop, but from what I've told that may not show up in badly worn chambers. This pistol is in high condition as you can see.

Well, that comparison pic shows that the frames are slightly different in size. There’s no caliber marking on the frame though so without trying different caliber cases or measuring the cylinder bores, one could not know the difference.
Not sure what you’re planning to do with this conundrum but if the seller won’t take it back, you’re options are either to register it restricted or sell it outside of Canada as a Frontier revolver.
