Hunters go to court over ban on grizzly bear hunt

B.C. professional hunting guides and outfitters are in court today to challenge a provincial ban on grizzly bear hunting that they say was purely political and not based on sound wildlife conservation science.

B.C. hunting guides and outfitters, led by Ron Fleming and his wife, Brenda Nelson, of Love Bros. & Lee are seeking certification of a class action lawsuit against the government, arguing the ban has caused them undue financial harm and was not warranted by conservation concerns.

In their petition to the BC Supreme Court, they argue that the decision to outlaw the grizzly bear hunt in B.C. has been devastating to the more than 100 guide outfitters in B.C. that relied on grizzly bear hunting as part of their business.

And how ironic that it’s the Guide Outfitters Association, who many resident hunters claim to detest, is fighting for all hunters in BC to harvest grizzly. Where is the BC Wildlife Federation in this fight? You know, the organization that is supposedly standing up for resident hunters?

No irony at all, all the power to them and best of luck! I don't think resident hunters "detest" guide outfitters. Some are not happy with the way they see them get to work their allocations and overharvest in good years when resident hunters don't get additional LEH quotas in those same good years, and some see their LEH allocations too high compared to resident hunters allocations etc. but all in all we recognize that we need to work together to protect our hunting heritage. As to where the BCWF is in all of this?, where they have always been, fighting the good fight as best they can.

Well, BCWF isn't in the business of selling hunts to wealthy people, so they have no ability to claim undo financial harm...

And who will be paying for this if the guides win? Us taxpayers...

I don't see anything that indicates they are trying to reverse the ban, just that they're trying to certify a class action to collect damages?

I've had a boo at the filing. While there is a compensation component, the underlying thrust is to get the hunting ban tossed.

Again, I wish them All The Very Best.

If that is their goal then all the power to them.

Is the filing available online somewhere? I'd love to give it a read later, I'll have an hour to kill tonight while I wait for my daughter's band performance to begin...

As far as I understand the filing is not online at this point.
I have a couple Buddies who guide that shared it with me (given my front line defense of the hunt back when) on the condition it remains confidential.
I will reach out to them to see if/ when they might be willing to let it become public.

Cheers,

Fair enough. Well, if the filing does end up on the internet (They normally do eventually through the court system I want to say? But I could be thinking of something else..) let us know. I'm sure I'm not the only one interested in reading what they have to say.

it would be a miracle if the province allows bc to go back to the Leh system on the grizzly bear hunts. as far as I'm concerned there was nothing wrong with it before. I have been told by others out in the woods say there actually seeing more grizzlies around than before.

I could be wrong but to my recollection this Class Action was certified already about 2 years ago and is now June 2022 going to Court.
Cheers
