The U.S. Commerce Dept. doesn't control those types of items..............The U.S. State Dept. does................

I found this thread interesting, so rather than rely on "a friend of a friend who never got his scope" type of information I decided the best way to find out would be to order a new Leupold myself off E-bay. I went on and found a seller who was set up for sales to Canada. I checked his referrals and he had about 20 positive responses in the first 10 pages from guys in Canada who had bought scopes off him. I bought one using the "Buy It Now" feature, and it showed up on my doorstep via UPS. The net savings were about 30%, so I would have to say it is definately worth it.
Without making any comment on the status of the seller to export, I have bought scopes on ebay from both US and overseas vendors and had no problem with them getting here. You tell an American selling on ebay that there are restrictions on export of scopes, and they will tell you that you are wrong.
Now for the Million dollar question, did you and the seller havve the proper U.S. Export permits????
If not you both violated U.S. Export laws and CGN policy on Canada/U.S. Exports.............
Mosy of those E-Bay scope sellers are stupid are just plain ignorant..................There ARE export restricitions on firearms optics..............phone the U.S .Dept. of Commerce yourself to find out.............

Well I guess you have to do what you feel is right...but I would guess that there are literally hundreds of them coming over the border ever day. My package was clearly marked as to the contents and there was no problems. Also E-bay closely monitors all sales for questionable activity. I know because I tried to buy a USGI fiberglass stock off there last year and I was sent an e-mail by them informing me that the seller was not allowed to send it to Canada and the transaction was cancelled.
This site sure opened a can of worms with "paper crimes"...pretty hard to say some are OK , like Bruce M's "paper crimes" and say no to others, like having a scope sent across the US Canada border..........
So if a major retailer says they will ship a scope to Canada, what are we expected to do, ask them for a copy of their export permit? When I bought stocks from Boyd's, am I expected to see evidence from them that they have authorization to ship a stock for an m1a/m14? How do I investigate that the stock is truly m1a and not m14 and thus prohibited? How do I do this thoroughly enough? Some US retailers won't ship any gun parts to Canada, and others will. So if I buy a trigger from one that will ship, do I need to ask them for evidence of their export permit? I'm also thinking about Smith Enterprises. They say on their website that they ship to Canada. Same thing there, to order a flash suppressor or scope mount, do I need to see evidence of their permits or authorization? It sounds like pretty much buying any firearms component from the US could run us afoul of laws that we have no way of knowing exist, apply or could be in a state of flux. $100 limits, $500 limits, its awfully confusing.

If the US seller makes an illegal shipment, the item will either a) come right through, or, b) it will be seized, your money will be gone, the seller may be prosecuted, and your name may be flagged, as someone who was participant in a effort to circumvent US arms export control laws.
No doubt lots of folks take advantage of US sellers who are either ignorant of their law, or who choose to ignore it. The smart ones don't brag about it on a public forum, and post the name of the supplier.
There are also US suppliers who will do the paperwork and legally export controlled goods (like Brownells). These folks may well have Cdn. agents, who are selling legally exported merchandise.

There is a difference. Importing a scope without the right permits isn't a "crime," paper or otherwise, in Canada.
Tiriaq, all the information may be available, but not readily. This seems to me to be a major US state dept blunder. If their own post office isn't aware of it, they've made no mention to Canada Customs (Hello?? Wouldn't that make some sense?), a major retailer in the US was reportedly fined millions for not following it. Its pretty much in the category of unknown other than to those on this site. Its tantamount to requiring us to research the laws of a foreign country before buying anything, from outside Canada. So if I buy a toner cartridge from the US, does anyone know that there isn't some obscure law in the US decreeing that it is unexportable technology. Sure, you could say of course not, but then you might be as ignorant as all those US retailers who aren't aware of the laws pertaining to rifle scopes.
