Antiques During Gun Ban???

Is there a legal reason why there seems to be a general thought that Antique
handguns will be immune to a ban if a ban were enacted,. ????

If fireams were banned then logically < ALL> fireams would be banned.

Antique or not = still a fiream.<<<<<
So maybe one should sell> or keep? Any thoughts on this???

antique as in muzzle loaders? if i remeber correctly you dont even need a license to purchase antique muzzle loading pistols

Well, I'm not a lot of help either but I seem to recall that the law differentiates between an antique pistol and an antique long gun. In other words, you're right, I do not need a license to own my flintlock rifles BUT i would need a license to own a flintlock pistol. I think.

I suppose this should be in the "legalize" section.

Nope. As long as an antique handgun is made prior to 1898 and is not of a specific caliber it requires no licence to own. They don't even need to be stored in a safe or cabinet, just unloaded.

Here's one of my antiques. No licence or registration required.

There has never been a logical, or reasoned firearms law passed in Canada. Trying to guess what the details of any new law would be is a fools errand. All we know for sure is that they will be stupid, illogical and screw legitimate collectors and target shooters. Let's just keep working to improve our lot rather than trying to outguess the crazy left.

To those saying don't talk about it; you need to know the probable law if you are going to defend yourself against it.

To the original question cc84-3 says that antiques are not firearms unless used in a crime. The critical issue however is the term firearms. I recall a case a few years ago where a person was charged for illegally possessing antique guns. I believe he was banned from owning guns not firearms and the term guns includes antiques whereas if he had been banned from owning firearms, he would have been in the clear.

nothing is immune from government ideology. are you going to turn something in , that doesn't exist on paper ? if your waiting to turn your non-existing antiques in , consider the EE thing first please.;)
 
I hate theses threads But.
most of the Perscribed Antique Handguns we Own in Canada WITHOUT any Licence you can also Own Without a Licence or Registraion in jolly old England.

Yes in England where near everything is banned most Antique Handguns are AOK

Only diffrence is they Cant shoot theres the way we can. If they want to shoot them then they Need a PILE of Licences and Crap.

So unless Canada gets worse than England (if it does im moveing) then our ANTIQUE Handguns and Rifles are safe.;)

The English have even more bigger Choices of Antique Revolvers ect than us.
But not much point if they cant enjoy shooting them.
If they packed one in the country side while hunting with Ferrets ECT they would be Charged.

Our Rules to do with Discharge are wayyyyyy Better than Englands

even if they were "banned" how would they enforce such lunacy other than catching you with one..?
 
You said it yourself, Legaly, antiques are not firearms. Not affected by a ban, so buy buy buy!

An OIC could change the status of antique guns in the time it akes to sign the document.
If you think you may be immune because the rules say its not a firearm, look closer, you will find that antiques get firearm status a soon as someone breaks a law with one.
If you were to possess one after an OIC says otherwise, you would face the same charges as if you had an M16.

How many people would risk keeping them if they were banned? Sadly most people could not afford the risk of criminal prosecution and would turn them in...myself included. I can't risk huge legal fee's, possible jail time or losing my job to prove a point. The personal satisfaction I would feel would be greatly outweighed by the suffering of my wife and children if I were to be caught/charged. I could be wrong but I think most people would turn them in voluntarily.
