Question about getting AR 15 Mags from the States

Can my friend in NY buy some AR15 mags, ones that we arn't able to buy here, take them home, pin them to hold 5 rounds and then send them to me using USPS?

Can I go to the States, buy AR15 Mags, pin them while in the states, and then bring them back across the boarder?

This has been answered many times before.

If they meet the legal requirements as far as magazine capacity, they are legal for import. The US may have its own export requirements. If the magazine holds more than 5 rounds, it must be modified BEFORE you bring it to Canada.
 
Keep in mind the pinning must be done to CBSA standards, not CFC standards.

i.e.; a pop rivet is acceptable to the CFC but may be rejected by the CBSA (or may not, it seems fairly arbitrary)

also, as sone mentioned, the exports of the mags is controlled by the US, should your package be checked by the US there would be consequences for your American friend and I suspect you wouldn't be welcomed back to the US.
 
to export from the U.S gunparts require an export permit

buy them in canada

NOT haveing the permit can cost you BIG time in $$ jail,and being banned from the us

You are still breaking US laws by being in possession of a high capacity[Non Resident Aliens that means US are prohibited from being in possesion of a High Capacity magazine] magazine as well as exporting ITAR restricted goods with out the proper documentation. As well as breaking Canadian laws regarding the importortation of Prohibited devices /gun parts unaltered magazine bodies are considered a prohibited device

Anyone else know anything about this? I heard someone did it with G36 Mags. Do those plastic PMAGS disassemble even? I heard they were fused closed.

Obviously its illegal without an export permit. If he is somehow intercepted by ATF agents from the gunshop to the post office, there is no doubt he would be severely punished. If he has a friend who is allowed to possess the parts, he could simply do it for him.

It only violates Canadian import regs if its mailed as a "kit," that means everything in one package. If someone were to mail the magazine body seperately from the spring and follower, it would be perfectly legal to import into Canada. Unaltered magazine bodies are not prohibited devices.

I ordered my G36 Mags from Germany, obviously US export laws not a factor there. I had the parts shipped in seperate packages.

Importing Magazine bodies whether altered or unaltered is against the law in Canada regardless of the country of origin. It means that the magazine must be assembled and modified to meet Canadian Requirements prior to entry into Canada.


Unaltered Mag bodies by definition are prohibit devices .Law States that all magazines must hold 5 rnds of ammunition for any center fire semi automatic firearm that it was designed or manufactured to fit . A Commercial Firearms license does not allow a dealer to import magazines that do not meet this requirement for retail sales to non government agencies .The mag body is considered a magazine that can hold more than 5 rounds of ammunition .Think I am wrong talk to the CFC or CBSA
 
Canada cutoms WILL grab and destroy magazine bodies over the legal limit

they will also often grab and destroy magazines pinned with pop rivets
 
I disagree, but I have no legal beagle expertise to back that up.

What I do know is that you can block a mag to 5 rounds without altering the mag body, for instance by welding a rod to the bottom of the follower or onto the base plate. Applying your logic means if I have one of these Canada legal 5 round mags, and I cross the border, take it apart, and turn right around, the mag body suddenly becomes a prohibited device because it is not rivited itself?

I'm not convinced.

Regardless, I'm not going to stop buying mag parts overseas.

My 20/5 mags for my M14's are "unaltered" 20 round bodies with a finned follower to restrict them to 5 rounds. Does that mean Marstar sent me prohibited devices?

No but your mags are in compliance when assembled, if you took your mags apart then they would not be in compliance with the law because your magazine can hold more than 5 rnds .
John@ good luck let me know how it turns out for you after CBSA get through with you when you get caught
 
So when I take the mags apart to clean, I am breaking the law because they hold more than 5 rounds? With no follower, spring, floor plate and baseplate they are hard pressed to hold anything in... ;)

A Magazine with no follower or floorplate can't hold any rounds. They fall out the bottom, cannot feed anything. Thats why for years we have been advised to keep them in parts until we get em pinned. Where does it say a mag body is a prohibitted device? I just re read the act and it mentions mags, not mag parts.

No, I believe they are controlled on the US side, possibly ITAR? Heck without permits you can't even export rifle scopes.... exporting gun parts/mags without a permit will probably land you or your buddy in jail... or depending on your skin colour.... cuba..... haha
