9x19 in a .40 S&W mag

I've heard from more than one person that it's possible to use a magazine made for .40 caliber in a 9mm handgun and fit 13 rounds in it. I know that, according to Canada's nonsensical gun laws, it's perfectly legal, I just don't know whether the firearm would function correctly or not.

Would a G17, for example, feed and function reliably with a G22 .40 magazine filled with 9mm?
 
I've tried it a few different makes of magazine... you can maybe get 5 rounds of 9mm inserted then they all fly out.
 
I do know that in the S&W 40 M&P that 9mm mags work.

by mistake, they sent me the wrong mags in a new gun , you can only get 8 rnds in the mag but no failures.

they sent me the right mags and let me keep the 9mm units
 
A buddy of mine has a .40 & I have a 9mm..... we tried it one day (we wernt at the range so we couldn't "try" it) You can fit 13 9mm in a 40 mag.... slapped it against the palm a few times.... the rounds stayed in there..... Next time we can get to the range at the same time..... we will probably try it out. we were thinking worst case senario is we would have to change slides...... 9mm onto the .40 frame..... but they appear to be the same size..... I guess I should dig out a caliper......

It works better with some mags than with others; depending on the design. For instance, with Berettas as mentioned it seems to work great without any modification to the mags. I have also done this with Glock mags, and have found that usually the feed lips have to be snugged up a little to reliably hold 9mm rounds in a 40 mag (i.e G22 mags loaded with 9mm).

What he is getting at is that the magazine is not magicly converted into a prohibited device simply by inserting ammo it wasn't origionally designed to use. It doesn't matter if the unaltered mag holds more than 10 rounds, as long as it only holds 10 rounds of the ammunition it was designed for.

Has this been discussed somewhere else that I can read? I'm pretty sure it is illegal to put more than ten rounds in a pistol mag no matter how they get (or fit) there.

So altering the .40 magazine in any way to make it work better with 9mm would be manufacturing a prohibited device.

As I see it, the crown would argue that an alteration to a legal .40 cal mag may constitute manufacturing a prohibited device.

Without alteration, it's hard to argue that it's illegal.
