Verifying procedure antique gun

The police took the shotgun to the station for safekeeping.
I contacted a verifier who has agreed to go to the police station, verify the shotgun as antique and to hold the shotgun for me and do paperwork for antique status and to de-register it.

My question is how long does that take. If he verifies it while at the police station as antique, why cant I just take it home with me right then (of course I would pay for him to drive me home with gun as I dont drive).

Should I be able to take gun home right then legally or do I have to wait until the paperwork is processed?

If the gun is a muzzleloading shotgun (ie- dosn't break open at the rear of the barrels. You can't look ino the rear of the barrels.) and there is no question about it's age, you should be able to take it home. There is no requirement to have any paperwork for an antique gun.
 
But how does having an antique lead to the cops confiscating it? There is an amnesty on for long-guns, so there is no legal issue. Did he take it into a 7-11 and use it to point out the magazines behind the counter that he wanted?
 
No the guns were registered with the registry and my dad's FAC had expired in 2008. No new FAC on file because my dad died in 2003. The police came to check the FAC out.

On the registration, there is no date stated for the muzzle loader shot gun which I am sure is percussion now that I am reading up and seeing pics on internet.

For the other gun, on the registration there is a date so it really is irritating me as to why (the police said) the registry is spewing out the reports, sending them to the police to check out the guns....but hey, this is Toronto where I believe I heard on the news they legislated guns cannot be bought and sold at the sportsments show that is going on right now?

I just hope our shotgun didnt end up there for sale.

My dad died very suddenly and we just didnt talk about these things. Well we got the letters from the RCMP last year about renewing the FAC which were passed onto my brother (the executor) to deal with. He tried to get into classes but not successful and time passed.

So not knowing the laws and that he probably doesnt need to get PAL, the police had easy targets here.

I guess 6 years is unreasonable time for the executor. The guns were not in executors possession either but that should not matter either as they most probably are antiques.

I just want the verifier to be there to make sure it is not a replica and make sure we get our gun back and not a replica (if anything was switched)........yea, I'm paranoid AND PROUD OF IT!!!

Correct me if I am wrong in any of the above statements except the paranoid one.....

If you could post the make, calibre/gauge, and model of the firearms involved, there are a number of verifiers on this site who could give you a pretty good idea of whether antique status would apply.
 
If the gun was previously registered, it will have to be deregistered with the CFC. The RCMP should have a firearms "expert" there to verify the gun and walk you through the process. If it isn't an antique then you will have to find someone with a PAL to transfer it to to get it out of the RCMP's clutches.

Would rather do that in person but as I said, one has a date which is before 1898 and the other is pretty definite.

A minor note; it is the current registered owner of the gun or in this case the executor who must apply for deregistration of an antique currently registered antique.

So brother has to transfer registration first from dad to him and then de-register I suppose or whatever....just deregister....I will let brother know to just do the both at the same time. He is hopefully going to fix this all ASAP.

For the antiques, your brother can apply to have them deregistered directly but will have to fax or otherwise send in a copy of the death certificate plus the portion of the will giving him executorship. He does not have to register them in his own name first. Guns judged to be modern in the eyes of the law can be transferred by him directly to the appropriate beneficiary as long as that individual has the appropriate PAL. Even though the executor may possess estate firearms without a PAL, the police will probably not release the guns to him now that they have possession of them. Also do not take as fact anything they may say pertaining to firearms act; at least locally they are notoriously inaccurate in their knowledge and will probably tell you what they think should be the law.

so if the Registery is shut down in that Vote in parliment in April would the cops have to hand the gun over?
Is the Fact its Registered to Your Grandfather Whatever the only problem.
or that you have no firearms licence to take ownership ?

I think with the Amnesty in Place you can still apply and get a POL if ya had a FAC before and let it expire.
People forget about POLs there for people who only want to keep the firearms they had or were willed to them Ect.
Its not to purchase new guns but to keep the ones that are legally yours or a Family members.
I think thats right if ya look into it.

That is probably not true; the firearms officers are refusing to honour the policies announced by the government of converting POLs to PALs and it might be reasonably assumed they will refuse to do anything which might make it easier to obtain a firearm.

Well I phoned the police division today to ask if gun could be delivered back to division so verifier could come to verify it antique. The seizing officer is not on duty until the end of the week. Division told me to phone property dept. I phoned property dept who said only seizing officer can authorize transfer back to division.

Phoned division back talked to Sargeant who said they will verify it and do investigation, letters will be sent out,etc. will take a couple of weeks if lucky.

Police dont seem to want to let me bring this govt qualified verifier in to do this NOW!

the problem at this point is police proceedure. Only the seizing officer can deal with seized property and since officers serve a week or 10 twelve hour days followed by a week or so off (forgotten the actual numbers), incorrectly or unnecessarily seized property therefore can require a week or more before
the seizing officer is back on duty and can deal with it.
