Carrying a deactivated pistol

What are the legal issues about carrying/transporting a legally deactivated restricted pistol?

For example, if I've got a legal prop 1911A1 that I wish to carry to and from an acting class. And if for some reason I am stopped by police, searched and found to be carrying it, concealed in a bag. Will I be committing a crime?

Hypothetical question at the current moment, but maybe a reality.

Why not just put it in a locked container inside your bag?You dont have to trigger lock it.Just carrying it loose in your bag might get you in some trouble.

Lots of people in Canada are charged with pellet gun offenses. Choosing to carry a fake gun is both A) ### and B) silly

Get yourself a good knife.

ETA: sorry, did you mean you want to attempt to carry this on your person in a holster or just carry it in a bag to you class?
 
Hmm, good question. Are you often stopped and searched by the police without a reason? :)



I'm thinking some snotty do-right in the class might call in a tip that I've got it, and I'll be greeted by officers when I leave the property.
 
In our current public hysterical climate it's wise to always cover your ass.
I would phone the police and ask them the proper way to do it. If nothing else, at least you would be on their office records of making every effort to do the right thing.

Get yourself a good knife AS A TOOL FOR OPENING BAG OF CHIPS and NOT FOR DEFENSIVE PURPOSE.

Put a little flag in the barrel that says "bang" on it. That should set the tone right off the bat.......:D
 
.. Carrying a "De Activated" firearm, is asking for trouble, if you're "checked" by Police. Why not simply get one of the brightly colored plastic "Training Aids" ?... David K
 
This reminds me when I was in high school, we put on play that had a gun in a couple of scenes. One of my buddies' father was a colonel in the French army, had a bunch of deactivated pistols at home, so he grabbed one and brought it to school.

When he got there he showed it to a few people and one dude started screwin' around, pointing it at people saying "hands up!"... What he hadn't taken into consideration was the fact that that was the day a couple of RCMP officers were at school giving one of those "drugs are bad" presentations. They saw him and promptly put a stop to that nonsense. Said friend just got a slap on the wrist from the principal and his father was called.

Man, I still consider myself a young guy but goddamn times sure have changed since then...
 
"...when I leave the property..." They won't wait for that. If it looks like it'll work, it'll likely be considered to be a replica and you'll be charged with possessing a prohibited device. A letter from your school might help, but most will go ape excrement at the very thought of any firearm(even though a dewat isn't legally a firearm) being on their premises.

I am in disagreement with everyone else in this thread. A deactivated pistol is nothing more than a metal sculpture; aside from being a convenient "blunt object" it has no value as a weapon. Acting class is a perfectly valid reason for taking it somewhere -- not that you need any reason.

That said, brandishing it in the open would be stupid and could get you shot but carrying it in a bag is perfectly legal.

Now 1939 makes sense [palm to head], the French army was using deactivated guns!! (and planes and tanks):D

Really, get an Asp Red Gun or a Ring's Blue Gun. The people in your acting class will feel better too (the police will not be acting or pointing deactivated guns).

Not a legally risk free proposition either.

You can get charged with several Criminal Code offenses such as: CCC Sec. 88 - Possession of Weapon for Dangerous Purpose, CCC Sec. 90 - Carrying Concealed Weapon, for carrying a knife if the attending/arresting officer feels that you are intending to use the knife for an illegal purpose such as inflicting injury/death upon another human being.

Carrying a knife for an innocent purpose such as fishing or hunting or as a trades tool is OK.

These charges can be laid at the officer's discretion depending on how he/she interprets your motives for carrying the knife.

The same knife being carried by a person in a fishing boat in the wilderness of Northern Ontario & in a seedy bikers bar in the GTA will likely be looked upon in a very different manner by the attending officer(s).

It'll be up to the Crown Attorney as to if & how the charges will be proceeded with and up to a judge or judge & jury whether or not you are found innocent or guilty.

Stupid question, especially when you know the answer already. Try carrying it into a bank, you will likely get yourself deactivated.
 
... Granted it is but a USELESS piece of metal, and No Longer a Gun ! But, "Looks like a Duck, walks like a Duck" well you know the rest ! The reality, is that if you were to be "checked", and particularly following a "tip off" or complaint, anonymous or otherwise, it would be a GUN POINT TAKE DOWN ! Would you seriously risk your life, however good intentioned, simply to "POSSIBLY" improve your Acting skills ? A new version of Method Acting perhaps ? Think it through a bit more, if Charged, and it would be a real possibility, a Criminal Record will be a "Millstone" around your neck for a long time ! ( Travel restrictions alone, if nothing else ) .... When there are so many other viable options, it makes no sense, to me, to even consider using a "De Activated Handgun" as Prop when the stakes are so high, and the gains, if any ,would be so slight as to be non existent. .... I own a "blue gun" and was advised when I purchased it, that if I were to "paint" it black, I would be susceptable to a fine not exceeding $10,000 and some quality jail time. I also had to provide a letter on CASD association letterhead as to the purpose of my purchasing a "Blue" gun.

The only firearm you can carry on your person is either the blue or red plastic training aids.

I can garantee that getting caught carrying a dewat will get you in a pile of poo!
 
Well, section 8 of the charter of rights and freedoms keeps you from being arbitrarily searched. Really, if you're ever stopped by the cops, there should be only 3 things that you should ever say:

1.) I don't know
2.) I do not consent to searches of my person or property
and 3.) Am I being detained?

If the answer is yes to number 3, the only other thing you should say is "I request counsel immediately."

As for carrying the deactivated pistol, I have no idea. Should probably check with a lawyer just to make sure.
