The post office has my sig!!

Here is my take on it after thinking about it; I did not get an authorization to transport. Had I been pulled over, and given a cop permission to search my trunk and he open up my sealed package and saw it was a gun, I would have been screwed! No question. But the liklyhood of that happening is pretty damn slim, probably have a better chance of getting hit by lightning on clear summer day.

And it's true I did not know the contents of the package, if u read my original post it could have been just the .22 conversion kit or even a mis-picked order. I never recieved a confirmation of shipping from questar
 
I've gotten a short term att here in bc in 10 minutes.On the other hand i've had it take two weeks for one as well.Sometimes they simply don't answer the phone whether you are calling the cfo direct or try to get transfered by the cfc.
 
A)Yes you need an ATT,
B)yes in order to comply with the rules of the ATT you need to "open box, trigger lock, put in hard case, lock hard case" at the post office.

So, let's say you do part (A), but not (B), cops pull you over you show the ATT and now they want to see the gun.....FAIL... gun is not legal as per transport regs....CHARGED

Now let's do neither (A) or (B), cops pull you over, you say you are transporting a gun, they ask for ATT....FAIL... they want to see the gun....Double FAIL....CHARGED

Again, do neither (A) or (B), cops pull you over, you say nothing, they know nothing of gun... well this is a case of see no evil hear no evil...Legal?? no but..No charges.

Now let's be Mr. Perfect, you do (A) & (B)... swat may show up... will you get charged ?? not for breaking the A & B rules but likely for disturbing the peace..CHARGED.. but Mr. Officer I was just following the LAW.... he/she would likely slap you behind the head and say "Use your f**ken common sense boy!!"

Also, in another example, restricted or non-restricted gun gets delivered to your house, your better half signs for it, he/she does not have the proper license......
Breaking the LAW, YUP!!!!! does anybody really care??? NOPE!
Under the law, only a licensed person can take posession of a firearm for which they are licensed.

So anybody still feel all lovie dovie with the criminal code & firearm act ??
When people talk about gun owners being criminalized due to our stupd laws, well here is a great example.
Same thing goes for anybody not licensed and having access to your guns at home, does your better half have the combination or keys to your safe....FAIL

But it's a package, some weeks I can receive 10 packages (gotta love internet shopping), how do I know which package contains a restricted firearm and which contains a video card? None of the boxes are marked "CONTAINS FIREARMS BEWARE", it would be against the law!

So when I goto the post office to pick up a package, I have no clue which package I actually received.

Those totally anal ATT laws are broken imo... especially in QC! You're totally right, they'll charge us if they can, but the laws are still broken :D
 
I actually had a conversation with my ATT issuers on this exact subject.

I argued that since my long term ATT allows me to take my restricteds to ranges, gun shops and gun smiths, it should cover me from the Post office too on any new arrival,
AS LONG AS I WOULD BE GOING DIRECTLY TO A RANGE, OR A GUN SMITH SHOP IMMEDIATELY FROM THE PO, BEFORE GOING HOME.
And from the Range or Gun shop, my LT ATT would cover me on the trip home.

The ATT issuer for BC told me I DID require an ATT to get my restricted firearms from the PO district outlet to my house. My long term ATT was NOT covering me. Rather than argue logic, I now just phone the ATT answering machine and leave a voice message telling them I want my ATT for the next afternoon or whatever. Since I ain't exactly a gun virgin, I can wait a few days for any new arrivals ... and in fact, have been known to wait days before bothering to pick up a new gun, and weeks before taking it to the range to try it out.

Since I am on a rural delivery route, with a neighborhood PO box, I always get a card/notice from the postman that any signature required packages or packages too large to fit in the PO box,will be left for me at the district PO, and not be available for pick up till the next afternoon. So far, the BC ATT people have always gotten me an EMAIL reply with the adobe file formatted permissions within a few hours.

In fact, just the other day, I got a phone call back telling me they were putting one of my ATT applicatuions to the top of their list for that afternoon,
merely because my application request was ORGANISED and CLEAR, and included everything theyt needed to do it!!!

Apparently that is NOT normally the case for most of the applications they get.
And maybe it is also because every time they do their job quickly and efficiently, I take the time to thank them and compliment them for it, and maybe even joke with them a bit

As far as the post office or any shipper is concerned they have a box what is in it is not there concern it is just a box until you open it.Then it can be regarded as a firearm.

Did you have to put a trigger lock and a locked gun case to take it home?

Your over thinking it again YOU say NOTHING to the cops, the police can NOT open YOUR mail.

ANYTIME your transporting a firearm you follow all laws (just like always right?) you don't get pulled over. you go home. your fine.
 
What does the paperwork (temp reg and ATT) that the dealer got to ship the gun say - I'll bet it says your home address - no short term required as the package wasn't delivered yet- it hasn't reached it's destination until you take it home.
 
But what if a one-eyed crow flying eastward drops a deuce on the windshield of the delivery truck? WHAT THEN?? Do you need to call the CFO to ask for special dispensation?
 
yeah, darkshadow is right, it is illegal to tamper with her majesty's mail, in other words, you are breaking the law if you open mail that is not addressed to you.

More food for thought:

I would assume the business that is shipping you the firearm got an ATT of some sort to ship it to your address, not the post office down the street?
 
post office? mine from the ee was shipped to my door. they didn't know what was in it.

the other restricted i bought from wholesalesports and they phone in to have the att faxed.

guess if they're aware its a gun... but why would a post office have to play that role?

I remember the time my 2 Norc M-14's arrived at the local 7-11 postal outlet. I got there just as the delivery truck pulled up and i helped the PO lady carry them into the store to do the delivery paper work. She goes "Gee, that box is heavy, whats it full of, guns?" So i says, "yep, got it in one" She looks startled and says "i was just joking!" and i respond "I know, but i'm not, been waiting weeks for these, thanks!" She just laughed, got back in the truck and left. good times!
 
Finally a thread where the majority agree that a package is a package! How refreshing. All those posts I made about NO ATT required to pick up mail in similar threads might have made a difference.

Calling the CFO about it is bad advice. They need to justify their job of issuing useless pieces of paper, so they will tell you one is required. I was told by the BC CFO back in 2005 that no ATT is required to pick up mail, and that is how I've been going about it since. The girl I spoke to would not issue an ATT for that purpose anyhow (so she said).

Unless you are going to trigger lock and put it in a proper container at the post office an ATT will not save you from prosecution. You will not have complied with the conditions of the ATT. But how can you? Restricteds come out of and go into the case at ranges, gunsmiths or your home only. The PO is not a legal place to case a restricted firearm. Furet said it best, damned if you do or don't. So make it simple and skip the BS and just drive home with your mail. There is no mens rea in doing that. If the package was marked externally as to contents there would be, but I can't see through cardboard and have no idea what I've brought home.

Until that box is at the address written on the front it is mail. The rules individuals have to follow for transport do not apply. That is the bottom line to me. So nice that many see it the same way...
