Type 97 Classification Issues - PART TWO

Clobb...if it turns into a legal challenge start the CGN funding campaign and count me in...small price to pay for larger implications...
 
Thanks for the offers to help guys, but I'm not the only CGN member who owns a T97. I'm unsure of how many people actually own one, does anyone know rough numbers? We'll have to wait until Wednesday to see what happens.

Yes, the correct way for owners to challenge this is to file for a reference hearing.

Hopefully we can get a coordinated effort going to assist the current owners.

Our case at the CITT comes up in the next few months. Allowing current owners to keep their guns this long, frankly, helps us, and current owners. The can hardly be that great a public safety risk.

I believe that Lever brought in FIVE guns at first (including his own personal one, the one that I am using in those Youtube videos.) followed by another 50 guns.
So 55 total, if my numbers are correct

I talked to the registry today and they have classed the T97's imported by Lever as FA. They are going to send me out a revocation notice next week and at that time I'll have 30 days to dispose of it.

They said I have basically three options:
- turn it over the RCMP
- try to sell it to a business that is legally allowed to have FA.
- challenge the decision in court.

Other points they made:
- The Lever T97's themselves are not grandfathered so I can't transfer it to someone who has 12-2 licence.
- They tested the Lever T97's under the Hasslewander criteria and they deemed them easily converted auto within a short amount of time. :rolleyes:
- They will not be offering any form of compensation.

So, any of you dealers out there want a Type 97?:mad:

Not surprised. The day you grabbed this gun, you should have expected this coming. There is a reason behind RCMP's decision. The owner of Lever isn't a gunsmith and has no idea what this gun is capable of. It's not like a knockoff M4 or AR15 which is well settled and proven in the market. Lever likes to import some odd stuffs to get its business profit maximized. I can't blame them for doing that. But having little knowledge of T97 and attempting to get it classified under restricted or even non-restricted only basing on its barrel length is very naive.

I disagree completely!
The firearm was manufactured as semi-auto, I've no doubt that the factory reps told the importer(s) that the firearm could not be readily converted.

Now you suggest that only gunsmiths with intimate knowledge of the manufacture and design of full-autos be allowed to import?

Sounds like you have detailed knowledge of the T97.. would you care to explain how's it's easily converted to FA, how long it took the RCMP lab to do so, etc?
 
Brutal. So it's happened. Clobber and company- my sympathies. Lever- what do you feel is your resposibility to your customers? Will you be buying them back? Insert mock surprise at answer here. Clobb- dewatt it if you can, better than nothing, and better than turning it in. It really sucks, but I'm guessing this may be a losing fight, I'm sure Can-Ammo has everything in the legal arsenal (no pun intended) at play here, and this decision has been a long time coming. Is there still a fight left, Can-Ammo, or is this done?

I googled "Hasslewander" and got this:

It sounds like the RCMP are saying they can swap the SA trigger group with a FA group or "Replica group" and get Full-Auto, or, remove a little something inside and get FA (very unlikely).

I guess the question is, how would one get these FA trigger groups? (If that indeed was the concern; are they even available? Unlikely.)

Either way, bad news. Hopefully CanAm has success in court.
