Encounter with a Game Warden

So the trigger lock is required if the ammo is stored with the gun in a vehicle.

Also you're not in transport if you leave your gun unattended in the vehicle, it would be stored at that point, would it not? What if I just left my gun in my truck all the time when I came home, it's not always in transport, it's being stored when it's parked and left alone, I would think.

Transport in an unattended vehicle, unless you are reall y "storing" it in your car.

Seems to me that the OP did absolutely nothing wrong, yet he was hassled twice.

Since that came out, there have been eighty-one responses, mostly dealing with how to get away with not breaking "the law". And "the law"itself has been quoted endlessly.

I ask three questions:
1. Where has our freedom gone?

2. Are you willing, if push comes to shove, to defend the politicians who have done THIS to you?

3. Is this system even worth trying to save any longer?

My experiences with COs has been pretty positive so far. However in the OP's situation I think I would have blown my top. Learn the rules and regulations. Keep a paper copy in your gear if you can. Argue until the prick goes away or gives up.

If all else fails tell him you are phoning the police and then do so (assuming you have service...). He won't bother anyone again without thinking it through after getting chewed out by RCMP or F&W for having to come out to the boonies because he is ignorant.

I was out scouting for a bears tuesday, got stopped by two of them. I said hello, identified myself as a bear hunter. he asked to see my bear tag, and i presented it. I seen him looking at my remington 700 on the seat (no locks, no case), i told him its unloaded. he asked me to prove the gun safe for him, so i exited, cycled the action. he said have a nice day sir and that was it.
 
We got pulled over coming out from our bear hunt this spring.

A truck with two guys in it pulled us over. I got out to talk to them. The first guy just about ran up to my truck to check for cartridges in the action on my rifle. Seeing none he started questioning me on where we had been, if we had taken any bears, etc.

As we had taken three bears we had to lay all the quarters out for counting, and unroll the hides for inspection. We were short one quarter which we explained had been damaged. Right about then a second pick up with two more CO's pulled up.

At this point they took all of our licenses, tags, etc and had a conference for about 20 minutes at one of their trucks. When they came back we BSed about the weather, where we had been, what game we saw, and then we went on our way.

While it was a bit of a pita as we were stopped for about an hour in total - they were polite and respectful throughout the check over. For us it was a case of those guys "doing their job".

I guess in any group RCMP, fisheries, and CO's there are a$$holes and good guys. I've been fortunate with CO's as I have only been checked three times in 35 years and they have always been pretty decent.

1. Our freedom has been lost, many years ago. We gave that up with our apathy as a nation.

2. No I would not defend our politicians. They are basically liars and cowards. Wake up and look around, sure they promise you this and that, but when it comes time for the results, there are no results. I have several friends who have immigrated to this country as we were supposed to be the "best" country. They wish they stayed where they were. Take a look at where we rank in the world in personal freedom. No so good.

3. No this system is not worth saving, but we as a population are too diverse to ever come up with a system that will work. There is a difference from Jaffray BC and Toronto... But try and get everyone to recognise that we need different things for our respective lifestyles.



As to the Provincial regulations not allowing the right to the protection of person or property, these provincial regulations are contradictory to the Canadian Charter of Rights and Freedoms. Hopefully someday a rich guy will get nabbed and have the means to prove this in Supreme Court. Many provincial regulations do not follow our rights as granted in the Charter of Rights and Freedoms.

Looks like section 7 would allow a firearm in a remote area for personal protection. Section 8 may have been applicable if the CO opened the door without permission, which you did not have to give. And from what the OP has written Section 11 may have been violated. As a LEO you need to be very carefull what you say to someone during an interview/interogation.

Why do Canadians constantly think the Charter is the top legal dog in this country?? They are essentially amendments to the CONSTITUTION. The Constitution is the foundation. Start there and read the section on "right to bare arms". Start there. Now follow it forward through the Bill of rights and the Charter. Was that initial right specifically extinguished? I think not.
The government has been acting against the Constitution and therefore illegally. They also own/control the courts, right and left are the same and you certainly cannot reason with them. You tell me what the answer is?
 
The Canadian Constitution was enacted in 1982, and the Charter of Rights and Freedoms is part of that Act. The prior constitution was null and void on April 17, 1982, when the Queen signed both acts, the British "Canada Act" and our Counstitution Act. We previously fell under British rule, and they still had legal obligation to our country.

Since the Charter of Rights and Freedoms IS the Constitution several refer to it.
 
This country is a big pile of garbage from a governmental and legal standpoint.
Can't count the number of people I've known who came to this country thinking its such a great place only to learn the TRUTH. What an over taxed and over regulated dogpile. Proud Cdn I'm not. More like embarrassed and disgusted.

I went away fishing at a friends camp in Westree, ON for the May long weekend.

This must have something to do with it.
I was doing the exact same thing on may long and the warden actually drove by while we were loading the boat and stopped to chat. he asked what was in the gun case, my .22 i said. he said have fun and be safe and sure to shoot into a backstop. i have never had an issue bringing a gun into the woods for target shooting. but then again i would also never claim for self defence. that was a good call to not play that card.
 
I keep coming back to the fact that this was an OUTDOORSMAN ,not some guy driving around with a weapon in his vehicle downtown at 1am .I'd be a whole lot more sympathetic to the authorities checking for guns and registration for THOSE people than some guy out fishing,hiking or target shooting-when was the last time people like that were a threat to the public safety?

Sir you must be American. There is no "Right to bare arms" in Canada. Maybe you watch too much american TV.

Here is Section 7:

"Everyone has the right to life, liberty and security of the person and the right not to be deprived thereof except in accordance with the principles of fundamental justice."

And here are your legal granted rights:
Section 7: right to life, liberty, and security of the person.
Section 8: right from unreasonable search and seizure.
Section 9: freedom from arbitrary detainment or imprisonment.
Section 10: right to legal counsel and the guarantee of habeas corpus.
Section 11: rights in criminal and penal matters such as the right to be presumed innocent until proven guilty.
Section 12: right not to be subject to cruel and unusual punishment.
Section 13: rights against self-incrimination
Section 14: rights to an interpreter in a court proceeding.

So I ask you, where does it say anything about the right to bare arms? Anywhere in the CANADIAN Constitution?
 
i don't know if this hase been asked yet in this thread ( i just skimmed over the previous 10+ pages )

who the hell gave him permision to search your truck ?

if the gun was out of sight , and the truck locked in what is considered a remote area , you did nothing wrong in terms of " storage " of your gun .

as for poaching he has to prove intent , and since your intent was a slug barrel , slugs and bear bangers ...... and not birdshot he doesn't have a leg to stand on , the only problem is the legal battle that may come latter , and not being able to make the officer involved finacially liable for their mistakes for causing you grief .
 
In fact, in Ontario generally it seems the legal principle of "presumption of innocence until guilt is proven" doesn't operate. There it seems to be that you are guilty of existing and of doing whatever it is you are doing, but officials have the option to decide to let you off according to their whims of the day.

Correct. The pain begins when charged, not when convicted.

This CO sounds like a idiot, who one day will cause himself grief by doing unlawfull search's and getting pulled into court.
I had a simular encounter with a peace officer last hunting season, the officer pulled me over for a traffic infraction and got me out of the vehicle,then proceeded to pull my hunting rifles out of my truck (no warrant and no permission to enter my vehicle) and throw them on the hood of his car, not gently set down but tossed like a piece of garbage. This guy was plain ignorant and rude but i did not feel like getting put through the ringer by this clown and getting in argument with a guy on a powertrip.
The second the peace officer pulled away i was on the phone to his supperiors they assured me the officer would be reprimanded, I have seen this officer a few times in public since and he always acts polite then hastens to leave my proximity.
