and for those doubters, here is an email from Ron Smith, the rply from my email to him informing him that the name of the flash hider we source from dlask had been changed to repsect smith enterprises registered trademark

Well this is good news, we are looking into retaining a lawyer now in Canada to deal with the knock offs up there. The name Vortex is registered in Canada now.
If there is more we can do on this end for you let me know as we are making our own receiver again and op-rods and more.

Start making the darn things up here so we don't have to deal with the US export laws crap. Maybe it would have been better to retain R33's services as local manufacturer.

But what do I know? I'm just one frustrated guy.... I want more M14 cheap parts, not necessarily concerned with international trademark laws. Heck, we build all these on clone Chinese M14s, so the "uber morale" issue is mute...
 
my original thought back when i joined CGN (as 45acpking) , was that hey, I can build these things..... and there's a guy an hour away that makes all kinds of cool parts. It was through seeing rooster33 parts on an M1A at the poco range one day..... that led me to join cgn in the first place. That and guys thought everyone here would like the stocks i was doing up for my friends.
My original plan was to try and team up directly with a local machinist/accessory maker and open a full in house M14/m1a shop here in B.C. . Associates here in the early days referrred me to rooster but i never did get the chance to meet him back then...... and then, quite suddenly, he closed his shop for good. I can't speak for the man though and everything i know about him and his dealings is simply hearsay and should not be given much credit here on the internet. I'm not out to offend the guy. I think it's a shame that his level of quality work is not being directed into making new and improved M14 accessories as it did appear to be his passion for some time.
I have found it to be exceedingly difficult to find folks i can work with that are capable and willing to make the many items i have spent thousands of hours at my bench designing. one day the pieces will all fall together...... maybe they won't hehehe

However, Dlask can not call the flash hider a Vortex without risking "trademark" violation ..... IF Smith Enterprise applies for and is granted trademark rights in Canada. Something he himself told me recently he was pursuing on all his products.

how about we put the issue to rest shall we. The dlask haters always come out of the wood work in threads such as this.
Dlask does not make a Vortex flash hider, they make thier own similar design which is now called a NAV Eliminator. I have personally compared the dlask version to the smith version and the dimensions are different. It is in Err that anyone refers to the dlask version as a vortex and that occurs regularly on this site and others.

and for the armchair lawyers here, the dlask product is not to the best of my knowledge in violation of the patent law or trademark law , and I am aware of no such proceedings to prosecute on the grounds of a violation and a continuing discussion on the topic will only further reveal those who will always slag dlask for thier own reasons....... fill yer boots i suppose. Ron Smith knows how to contact me, if he wishes for me to stop installing Dlask NAV Eliminators, all he has to do is ask....... and again..... see the above copy of my personal communication with him (not his lawyers) on the matter.

I discussed this idea with Smith ent and the problem is not granting a liscence to a shop smith ent approves of it is that with the ITAR controls in place on a substantial part of Smith Ent's inventory, the granting of a liscence to manufacture for smith ent, in canada, would be nixed in the bud by ITAR....... to the best of my knowledge and personal discussions on the topic.

i'm frustrated to as I would drop all other accessories from my inventory and offer the full array of smith products...... if it was feasable or doable without having the ITAR restrictions rain on my parade.
 
Canada is the recipient of an ITAR exemption related to the 1963 Defense Development Sharing Arrangement with the US Government. This exemption was effectively suspended by the US Government in 1999 over concerns related to the employment of Dual and Third Country Nationals by Canada and Canada’s refusal to ban defense exports to countries proscribed by the US (among other factors). The exemption was only regained, after considerable effort by the Canadian Government, in 2001.

I really thought that that bogus was behind us....
I was definitely surprised when some guys in Europe could order things from US that I could not. Even more surprising is that M1A is made - the receiver at least - here. They surely don't use Springfields... do they?

My suggestion was that the said shop would manufacture for Canadian market..... maybe exclusively. Surely, with all the Norc imports we have a huge market for parts. I'd dare say better than US - excluding military contracts.

ITAR and other similar US legislation will prevent a company like SE
to export flash hiders for civilian use
(but experience shows that sometimes, some applications were approved).
Also, US legislation specifically prevents any transfer of
most mil technology, designs, expertise etc. from US to another country,
(unless under the very watchfull eye of the US gov).
Because the patenting process involves disclosure of a lot of the technical details,
then these bans were extended to patenting of US mil products outside US.
So, the Canadians are quietly waiting for SE to patent their products here
(but, you know, some people don't like waiting).

Thanks to "7.62Nato" the origin of the Flash hider has been determined! It appears it can be replaced... As M14Doc pointed out it was NOT a dlask item.

I like CGN alot. :D

I am not an expert but by all other standards this rifle has performed really well for me and this was an isolated incident for it. I am fairly baffled by it.

Also kind of interesting to see how much conversation such a seemingly minor inquiry can spark here!

Before i spring for a new one, a friend will be in the area this coming weekend and will try to find it. Will advise.
