Norfolk County : Norfolk Trio Fined to Failing to Immediately Tag Deer

Failing to immediately tag two deer that had been shot has landed three Norfolk residents with fines. Court heard the three were party hunting in Norfolk and had shot two adult white-tailed deer, field dressed them and strapped them to an ATV. That's when they were stopped by a conservation officer who noticed no game seals were attached to the deer. Keith West, Larry Benz and Janis Benz have been fined a total of $4650 in hunting charges.

A bit heavy handed IMO. If they did indeed have the tags to cover the deer then it should have been less harsh. Totally opposite if they were shy the tags, or had previous convictions.

From what is posted here is sounds like the same thing that I seen when I was driving back to my cottage in Turkey Point from my hunting spot.
From what I seen it looked like they got the deer taken away and the ATV.
This was the first week of the shot gun hunt when i seen this.
Glad they are out there doing there job.

I am not going to say I feel sorry for them. I have personally witnessed guys riding on moose and/or deer in the backs of their trucks, tag in hand trying to make it home w/o getting caught so they wouldn't have to use their tags and be able to collect more game. One of the guys I saw do this was the MAYOR of a small town in Northern Ontario who shall remain nameless. I am sure those exact same kind of thoughts go through a C.O's mind when he finds someone transporting w/o sealing. And lets remember, it is the judge who lays down the fines after hearing the evidence. $4K split 3 ways really isnt all that heavy IMO, but thats just my opinion after all.

Law says the animal must be tagged immediately after it is killed and recovered. I tagged my deer before I even gutted it in case I was checked during that process. I don't feel the need to give the gov't any more money. They collect enough in taxes from me, never mind fines!

I would have liked to have seen a 5 year hunting prohibition as well.

Our game management system does rely on the integrity of hunters, and these turds had none.

Moved a deer without tagging. What's the limit? Gut without the tag? Out of the bush with out a tag? In the truck without a tag? Home with out a tag? Process it in your garage with out a tag? Freeze with out a tag? Oh wait, I still have a tag, I can go hunting tomorrow!!

I bet they gambled and got caught. Probably the first time they've been caught too. Hope they've learned.

I think the Ontario law says "as close to the kill site as possible".
With that in mind, we frequently do not tag until we get to the road. So the tag doesn't get ripped off during the drag. Last year I dragged a buck better than a mile over some pretty rugged stuff.
Tagged it when I was within sight of the Jeep.

Exactly what we do as well...but in this case it sounds like these guys were trying to save the tag and got caught...going rate is about $1500 apeice I hear..and the MNR can confiscate the ATV,GUNS,TRUCK..etc....
Could have turned out to be an even more expensive lesson in hunting ethics

Some more to the story....

Fines totalling $4,650 were recently levied against three Simcoe-area hunters for being in possession of untagged deer.

The charges against Keith West, Larry Benz and Janis Benz were heard before a Justice of the Peace in the Ontario Court of Justice in Simcoe Jan. 27.

JP Norman Malloy heard that West and Janis Benz were party hunting Nov. 1 in Norfolk County when West shot two white-tailed deer. The party called Larry Benz to bring an all-terrain vehicle to the scene to retrieve the game.

The deer were field dressed and loaded onto the ATV. When a conservation officer stopped the trio, there were no game seals attached to the deer.

The Fish & Wildlife Act requires that a game seal must be attached to a deer immediately after it is killed and before it is transported. The day, time and month of the kill must be notched into the seal.

Larry Benz was also charged under the Off Road Vehicles Act for failing to wear a proper helmet. His fines totalled $1,650. West was fined $2,000 while Janis Benz was fined $1,000.

The deer and valid game seals in the party's possession were seized and forfeited to the crown.

Would have been so simple just to tag the animals. They could have possibly be giving attitude to the CO and then came the helmet charge.

The law is the law, go with flow things will be fine, try to buck the system you'll get caught.

They are proably mad at the CO for doing his job and not mad at themselves for trying to pull a fast one.

The most common tag violation is not notching the required info!

Although the intent is to safe guard the tag while transporting it threw rough terrain. The law still requires you the individual with the tag to go to the carcass and tag it before it is moved period.

I am aware of a few stories that have been told that the animal was to small and not worth the tag. Or it was a shot by mistake (no doe tag). Joe is on our way out, he will tag it as we go by him on the way to the truck. In my view the cons outweighs the pros.. So like I previously stated the intent may be there, but the law is the law.

Good luck with selling the intent with the conservation officer.

In Manitoba the tag does not have to be attached until you are transporting the animal,however the tag must be notched with the date immediately upon retrieval. I would consider dragging a deer out retrieving but a deer lashed up on an ATV is transporting IMO. These guys rolled the dice and threw snake eyes.

Actually the wording in the reg's is "IMMEDIATELY" and "AT THE KILL SITE".

So the picture that was taken of you at the kill site of you with an un-tagged deer, could be used as evidence against you.

Want to protect the tag...tightly wrap it with a long leather lace.

And don't forget to notch the time and date out of the tag.
