Legal Scenario for ya.

It might be illegal to cut a tag if you don't retrieve the deer.

I wouldn't cut the tag unless I was going to retrieve it or at least part of it like the antlers.
 
You've said a few times its the LAW. Can you provide a reference to the F&W Act where it says so?

I heard it was law, and was sceptical. Then I called the MNR. Not once but three times to talk do different people. All the same answer. Thats the law.

What would you do?

Ever sit in your stand until dark????? Anything can happen. If I don't see the deer fall in sight, I leave it for a minimum of 15-20mins before looking for it.BUT If I had a hard time finding it, I would go get my dog to find it for me. Has never let me down.

I find that bow hunting is by far the worst for having to look for game while hunting in the evening.This is where a dog shines.

What would you do?

If there was something salvageable, I would tag and salvage. If it was a total write-off I would keep the tag and go looking for another one. If there is nothing to recover there is nothing to tag, in my opinion.

It wasn't opinion. I asked if it was definitely law. They all said yes.I wanted to be clear, as I thought the same as you.

All three I talked to were wardens from different districts in Ontario. Two gave me answers right away, and one was not positive, so he called me back later with the same answer.

Wardens are not the law, the JP or judge is. I was threatened with charges by a warden 2 winters ago and they never made it past the prosecutor and I received a letter to that affect.

In my scenario above I would have no problem going before a judge/JP and explaining myself.

Your honour, I shot a deer, I tracked it until dark but did no recover it. I resumed tracking in the AM and came upon a deer carcass eaten by some predator. I never did recover my deer so I did not use my tag.

It is the COs job to say it was my deer and that it was unreasonable for me to stop tracking at dark. If DNA proved it was my deer (12 months later), how could I at that immediate time know that. It is unreasonable for me to assume otherwise.

Maybe your arrow was there..You recognize the rack.? You just know!

Either way it would be a very hard law to enforce, unless you, yourself volunteered the info.

I just wanted to see what everyone else here thought about it.What they would do.Especially the ones who say the do everything by the book.My bet is 90% wouldnt cut their tag. Even the ethics cops here.Surprisingly none of them chimed in.:rolleyes:

True enough. I wonder how many on the TV programs get ate, as you see them do alot of next day retrievals. I personally would not eat a deer that layed all night with the guts it it. No way,no how.

P.S. I would have difficulty tagging a half eaten carcass myself.
 
I think what you have presented is a far question and debate, and the court stuff could go either way as we know how well the courts are in Canada.

Ethically, If I don't recover the deer it is not mine to tag. If I recover it but can't retrieve it until morning, I tag it, it critters get it before me than I am SOL and recover what I can for whatever I can use it for (food, bait, dog food, etc).

FYI, I am a trapper so the use of an animals carcass by natures predators and scavengers just seems natural to me. Most of my beaver feed hungry birds, wolves and other scavengers. Its just natures way.
