Just learned a small (Duh!) lesson today ...

I've been unable to fiddle-around closing the action on an empty chamber when the magazine is charged on my new Marstar Chines SKS. There was just no "play" in the system to allow any wiggle room.

Until I switched from five rounds in the magazine ... to four!
 
It seems out of spec by a bit. It should take 5 1/2 rounds so you can close the bolt without one in the chamber. A five round magazine capacity means it holds five rounds.
 
I can jam 7 in to mine and it is pinned, not sure if it will cause legal issues, i only ever put 5 in it, but i can fit 7
 
Like I said ...

The magazine will hold five rounds, and the last one fits in so perfectly that there is no subsequent play in the vertical column. Maybe this batch of magazines were modded down to five rounds exactly, not 5.35. That's why I mentioned that it was one of the unissued Chinese military models being sold by Marstar ... to find out if other owners of this "batch" have experienced a similar situation.
 
My Chinese SKS's magazine could never fit the bolt over a loaded magazine, it was pinned to little more than 5 rounds as well.
As far as the legalities go, If you can fit 5.9 rounds in there it's legal, but as soon as you can JUST squeeeze that 6th rd in under heavy thumb pressure (like the 10th rd on my Kalifornia Glock mag) than it's not worth the risk to not have it replaced or fixed ASAP.

God knows we have some paranoid enough stories out of the RCMP lately.

Sounds like the block/pin was set in a bit higher than spec. I'd grind it down if it were mine so I can safely/legally fit 5 in the mag with the bolt closed. I have two Marstar rifles of the same vintage with no problems holding 5 in the mag.
