Legal to import Marauder kit for 10/22?

I did some searching but couldnt come up with what i was looking for.

Went to US for a shopping trip and drove past a gun range and decided to go in and see what they have. Ended up renting an MP4 22LR and shooting 200 rounds with my girlfriend. She loved it, and that kinda peaked my tacticool 10/22 interest again.

I've been eyeballing the Marauder kit but i cant find it anywhere in stock in CAN...i found it in US so my question is...

Since its not an actual firearm, can i purchase it and ship it over from US? Do i need a licence to do so?

True. Jerry sells 'em as fast as he can get 'em. Try phoning Jerry - the website is not always updated as to stock. They were out of stock when I ordered mine from Mystic, and I still had it in my hands about a week later.

Good point. It would be legal for anyone to import the Marauder kit into Canada (without dealing with it as a firearm) as it is neither a firearm or a true receiver.

Now, whether a dealer in the US would export to a individual in Canada, that's another matter. It seems that a lot of the US distributors are so tired of dealing with Canada Customs, regulations, rules etc., that they refuse to ship to Canadian individuals. Considering that it means lost revenue to these companies, you can bet that the problems were serious enough to make them just walk away from Canadian buyers. Unfortunately, everyone loses.
 
No it's not legal. Nothing to do with Canada Customs. It's US export law. You have to be registered to export firearms and FIREARM PARTS out of the US. Once you are registered, you need a licence to export a firearm / part UNLESS the order for parts is no greater than $100 (wholesale) AND it is not a part specified in ITAR as non-exemptable (ie: Barrel, Receiver, Complete Breach Mechanism, etc). Unless you are registered you can NOT take advantage of this $100 exemption.

In short, a Canadian CAN NOT legally export ANY firearm ANYTHING from the US on their own. (Cole's Notes version) In fact, it is my understanding (though I can't find the legal reference of the top of my head) that it is illegal for a Canadian to purchase a firearm part while within the US.

^^That was my point. There's nothing illegal, as far as Canadian law is concerned, about importing a Marauder kit. I don't believe that the kit would be an ITAR-banned export item, as it is not (nor includes) a barrel, receiver, breech mechanism, etc.

That having been said, the currently-imposed $100 limit might be a factor, assuming the kit was ruled to be a true "gun part". Any US dealer/exporter dealing in Marauder kits would know the answer to this item, specifically. The $100 limit is, I understand, currently under review, with an eye to raising the limit to $500. That would certainly make the Marauder kit acceptable for export.

We'll see...

Stocks are generally not exempt from ITAR and I expect it would be considered as a stock for export purposes.

It certainly is.

ITAR 121.1

CATEGORY I

(a) Non-automatic and semi-automatic firearms to caliber .50 inclusive (12.7mm)
(h) Components, parts, accessories and attachments for the articles in paragraphs (a) through (g) of this category

The Marauder kit would certainly be an accessory and/or attachment, and therefore subject to ITAR.

The only significance of the "Barrels, cylinders, receivers (frames) or complete mechanisms" for the purposes of this discussion is that those parts can never take advantage of the $100 export exemption for registered exporters.

The only (legal) solution (besides buying in Canada) is buying from a US vendor who is registered as an exporter that is willing to ship from them in the US directly to you in Canada.

Did you read as far as 121(2), which excludes accessories such as scopes and other parts and attachment that "do not enhance the usefulness, effectiveness or capabilities"? I also note that the primary focus of 121 is military weaponry ("Significant Military Equipment"). It goes on for pages and pages about the export of tanks, Naval vessels, functional artillery, military grade explosives and propellants, antiaircraft missiles, etc. I doubt that a plastic stock kit for a .22LR 10/22 is considered "SME"...

On a side note, I see there is a fresh thread alluding to the newly-increased export allowance (to $500). It'll be nice when that's confirmed...

You mean the "NOTE" after 121.1 (6)? Yes, and I believe that the Marauder kit would indeed be deemed to enhance use, effect and/or cap by a US government official.

I, respectfully, disagree with your read of the "focus" of 121. 121 is a munitions list. Plain and simple. The "*" items are marked as such because they also happen to be SME. Being a munitions list, of course it should included the full gamut of weapons, right up to aircraft carriers. Seeing an asterisk next to semi-auto's up to .50 tells me that the US government would consider a stock 10/22 SME, let alone "enhanced" with a military-style stock.

Well, I guess that could be so. I suspect that a US Marauder kit retailer would know for sure. Hopefully someone who's trying to get one could find that out for sure. I'd do it, but I already have one!
