I was out in the backyard near the chicken coop... saw a raccoon running towards the tree i was standing beside. grabbed a 2x4 off the scrap lumber pile and took a swing (happened to be the only one with no nails sticking out of it from being pulled apart from the old chicken coop)

Not long time ago one guy's backyard was invaded by a raccoon family.While chasing them away he hit one with a shovel. His lovely neighbour saw it and phoned the cops. As a result he was charged with assault with a weapon.
My friend, now I pray that nobody saw you hitting this cute bastard. You know, 2x4 is a very dangerous weapon.:D:D:D

I don't think they could charge someone with "Assault with a weapon" if the victim is an animal but they could lay an animal cruelty charge for sure.

It was in Onscario if I remember right apparently the critters were squalling something fierce. I can't remember the charges or much eltse of that issue but it boiled down to its illegal to beat those bandits to death with a shovel when witnesses are present. Them little bastards scare me more then bears scare those in the BDTs and I can't think of anything more fun then a nine iron and a stinkie garbage can un less its gophers and ammo.

Regarding the raccoon getting beat with a shovel, the guy got charged because this happened in...you guessed it, Toronto. There is a bylaw in toronto stating you cannot kill anywildlife within city limits. I believe he also got charged with animal cruelty cause he was pounding a mother and it's young when the neighbor peered over the fence. Them's bad optics for poor old city folk. He did get a LOT of support from other frustrated home owners that were sick of the critters ripping their property apart. Don't know the outcome though.
