is it legal to carry out of the store a new rifle without buying a gun case if the new rifle is in the factory box ? (or do i need to buy a gun case before going)

A box is considered a case, by definition... so would be tightly rolling it in a blanket... but you would be best served by bringing a case with you or if you don't have one, buy it there.
