It's really simple. The Swiss Arms is out-of-contention until this mess gets solved. And honestly, there's no guarantee of compensation if the efforts to reverse the decision fails - so it's a $3,500 gamble. If you want a great, durable and reliable all-around gun - the Tavor is it. If you want something in a different calibre for hunting as well as plinking, get an XCR. If you don't care about restricted status, get an AR15.

There are some people who feel squished shooting a Tavor. There are some people who feel like a construction crane when pointing an XCR.
