AR folding stock question.

Hi there, Not too sure to put this here or in legal. I am wondering, if I put a folding stock on an AR rifle would that make it prohibited? With the stock folded it would be under the 660mm but non functional. It would only be able to function while the stock is in the open position? Would this be legal and considered restricted still? I'm thinking essentially with the rifle not operational while folded it's almost like a take down version of a rifle. Any ideas? Thanks!
 
Doesn't matter if it's functional or not as the AR is restricted. Firearms that can be fired while reduced to less than 660mm by folding/telescoping are Restricted, not prohibited.

Sorry is there any reference to that? I'm just a little confused in the wording on the RCMP website. It states a prohibited as:

"a firearm that is adapted from a rifle or shotgun, whether by sawing, cutting or any other alteration, and that, as so adapted,
is less than 660 mm in length, or
is 660 mm or greater in length and has a barrel less than 457 mm in length."

I don't understand how I could take a restricted and shorten it to less then 660mm and it wouldn't fall under the prohib category.
 
If you chop a restricted gun, it does become prohib - if you make the gun into another variant of the same gun by swapping in parts, it doesn't. I know, makes no sense at all. If you change a non-restricted gun so that the length is under 660mm, or if a semi auto, the barrel falls under 18.5 inches, it becomes restricted. Folding stocks aren't widely available for the AR platform, due to the buffer tube assembly requirement.

That section is to make sawn offs illegal. The issue of adding folding/telescoping stocks are covered in a different section.

“restricted firearm” means

(a) a handgun that is not a prohibited firearm,

(b) a firearm that

(i) is not a prohibited firearm,

(ii) has a barrel less than 470 mm in length, and

(iii) is capable of discharging centre-fire ammunition in a semi-automatic manner,

(c) a firearm that is designed or adapted to be fired when reduced to a length of less than 660 mm by folding, telescoping or otherwise, or

(d) a firearm of any other kind that is prescribed to be a restricted firearm;

This is why it's important to read all related legislation/regulations/definitions.

This is found in the Criminal Code and Firearms Act. Do yourself a favour and read the actual legislation, rather than relying on the RCMP website.
 
In law the specific over rides the general. The law you quoted is general in nature. The AR15 is specifically listed as a restricted firearm. Thus the general bits don't count in the case of an AR.

If this were not true then the addition of a bolt action upper would render an AR lower non-restricted. And the addition of a cross-bow upper would render an AR lower as a non-firearm. This is why ALL AR lowers are classed as restricted, regardless of what the upper configuration is.
