With any luck, these men will be charged on this appeal by the Crown.......one would hope.

The Crown is appealing the decision of a provincial court judge who tossed out charges of illegal hunting against three Lower Mainland men.

The three men were accused by the Crown of using deer in the High Bar area of the South Cariboo as target practice.

A lawyer acting for Paramjit Singh Chahal, his 23-year-old son Sukhraj Singh Chahal, and Sukhvinder Singh Kalkat challenged the case under a section of the Charter of Rights and Freedoms.

The Crown alleged three mule deer were shot on Nov. 12, 2010, at OK Ranch, in the South Cariboo about 50 kilometres west of Clinton.

Defence lawyer Mark Rowan argued charges should be stayed, saying an unreasonable delay in a trial is a breach of the three men's Charter rights.

Judge Stephen Harrison agreed, ruling the delay did breach the three men's charter rights, including the right to a fair trial. The defence was not responsible for any of the delays.

"This is clearly the result of (a lack of) institutional resources," Harrison said in his ruling last month. "There is great demand for court time in all three divisions and lists are frequently overbooked."

Prosecutor Joel Gold said the Crown is challenging that ruling. The appeal is set to be heard the week of March 17, in a one-day hearing.

They need to fix the court system... 3 years to get to trial? I read in the papers all the time about impaired charges being dropped & all sorts of other things because of back log in the court system... its a joke
 
Try reading the article. The judge agreed that the defense was not responsible for the 3 year delay. Case dismissed. What's the ethnic background got to do with these posts?
 
Shooting any creature your not going to eat just proves your a complete idiot and ass , not to mention the bad karma that comes with it ! Ya I know I'm sounding like a hippy again lol , it is good to know that at very least there names and pictures have been released to the papers in there communities so all their neighbours and friends will know what kinda of people they are .

This. I believe in the original story one of the COs was off work on medical which contributed to the delay and, IIRC, one of the accused was out of the country for an extended period. But that's just my recollection. The details of the case were pretty bad to see then walk on a technicality. Interesting to see how this winds up.

And to the knobs...keep the racial crap out of it. It only makes you, and by association me, look like an idiot.
 
If our system is so ####ed up that it takes 3 years to bring these men to trial then I fully agree with the judges decision to let them walk.

It looks good on our pathetic legal system.
 
I didn't know you could tell if someone was new to the country or second or third or fouth generation Canadian by their names... I hope you don't want to deport Grezky to Belarus if he commits a crime LOL

A few CGNers are talking like these guys were already guilty. And FYI, charter rights guarantee them the right to trial within a reasonable time. 3 years is clearly unreasonable. Like it has been said already, what does race or ethnicity have to do with anything?

Agreed, three years is unreasonable and they should drop the charges. People can't remember what they had for dinner last Tuesday, let alone the actions they witnessed 3 years ago. Any witnesses have heard about the case in the news, discussed their feelings about the case with friends, and formed new opinions and possibly new stories. The case cannot be judged fairly at this point, and trying to establish guilt beyond reasonable doubt will be hard to do after 3 years.

However, in any case no matter who the people involved are, or the crime, its an injustice to let people walk away freely before even going to trial. I can imagine how excited they were to hear about the charges getting dropped and having a big sigh of relief.

The only winners in the this case are the lawyers.
 
It's not about race. It's everything to do about our culture and respect for Canadian laws and provincial hunting regulations.

If any of us were to do the same thing in any other country, we could expect the full brunt of thier court judicial system as well.

Edit: If the facts are proven in court, this should be treated no differently then the occassional American slob hunter that shows up on our prairies and slaughters dozens of waterfowl. Only to then dump them in a landfill. With the help of an outfitter no less!

There is a thread started on here a while back regarding these fine folk and their disconcerting values
of our wild live stock.
My searchfoo sucks. I did try and find it to bring it up to date with this appeal.
There was quite an up roar over them getting set loose. They cried fowl as it seemed to of
hurt their so called reputation to do other things in life.
Maybe someone here with better kom pute ter skills can find it and marry the two up?

I know I was sure pizzed at the out come of the proceedings.


Not having read the article posted by Kamlooky I am wondering why it took three years to come to trial.
Did the accused cause any of the delays?

Just curious, what is their relation to the ok ranch, were they passing through, or new owners, how were the caught?

I don't disagree...perhaps if the govt didn't systematically turn EVERYONE into a criminal or sorts, the courts wouldn't be so bogged down. This was the legitimate cases could be heard
