if we llok on internet they say that gun was made un 1944 wikipedia says it it should have more than 5 round ^^

LOL - I'd like to see that stand up in court. It's called the RPD-44 for a reason.

The RPD actually SAW SERVICE in 1944. The belts were invented and produced in 1943. This is fact, not opinion, and the RCMP is bound by legislation, not whim or fancy. the law clearly states DESIGNED.

From the Crminal Code of Canada, Part 4, para (f):



So in other words, if it's original military production, it's golden because the RPD was "in existence" before 1945. As far as the law is concerned, if even ONE example was "in existence" prior to 1945, their hands are tied.

EDIT: I do NOT intend to ridicule the moderator's post, when I re-read the above, I see it could maybe be construed this way. My intent is to ridicule the RCMP lab's supposed argument - I agree with tootall on what he said :)

Compare:

1.
(f) is of the “belt” type consisting of a fabric or metal belt, is not a reproduction and was originally designed or manufactured for the purpose of feeding cartridges into a automatic firearm of a type that was in existence before 1945

with

2.
(b) was originally designed or manufactured for use in a firearm that is a semi-automatic handgun, where the magazine was manufactured before 1910

They come from the same set of regs, few paragraphs apart.

If the goal was to have belt made before 1945, the regulation would have said so.

Here we have the requirement that only TYPE of automatic firearm existed before 1945.
