One thing though, and this is germaine, if the mag is modified in any way it becomes prohibited.
You can bend the feed lips in slightly if 9 mm falls out. However it MUST still accept & feed .40 otherwise it could be argued the mag has been modified.
That is a $50,000 argument that even if you win, you lose.
