Yes, that is true, but to an uneducated jury, it will appear less malicious than just shooting the guy outright. You will be charged whether you shoot him, stab him or beat him to death, the resulting charges will be the same.You don't shoot a deadly weapon to wound whether its with less lethal ammo or not
