Well its been 17 months since I bought an FN FAL from Epps, it went to Ottawa to the lab to be checked.
They say it takes 6 months but one of the technicians told me its really 18 months. It sat in the mail room at the CFC for 4 or 5 months before being entered into their system, so if that's the case its been there about 14 months.
If young Pierre gets in the next election, I will probably never ever see it.

I know situations like this are legal purgatory, but can't you follow the chain of command until you find a responsible individual - and then call them every week until they get sick of hearing from you? This has sometimes worked in my dealings with the bureaucracy. ("Really Sir? It takes 17 months to assess the firearm? Well, it's a good thing the RCMP will never be privatized - I'd get fired if it took me that long to evaluate a product. Ha ha.")

Bought 12.3 rifle in July 2013. 2 months pass and the RCMP decide they want to examine it. Sent to them Oct 5th 2013 . Still waiting

wow almost 2 years!
so basically they hold on to your rifle for inspection for perpetuity... nice way to confiscate guns without officially confiscating it, therefore never having to answer to anyone since it was never confiscated.

Thats like putting handcufs on someone, putting him in a cop car, throwing him in jail, locking the door, serving him meals, but never officially arresting him so therefore never charging him sounds like a Good Wife episode.

Wow what a crock of BS. We need to stand up for ourselves and make our cause known to people.. being quiet how we have been is getting us nowhere. Look at all the groups that go out and make huge stinks publicly and get what they want, ### rights, womens rights, indians, etc etc

White males don't matter, what they want, even if they voice for equality, it's somehow wrong.

I say 'people should be treated equally' on CBC comments, no doubt someone writes, 'spoken like a white male'

Mandamus is a judicial remedy in the form of an order from a superior court, to any government subordinate court, corporation, or public authority—to do (or forbear from doing) some specific act which that body is obliged under law to do (or refrain from doing)—and which is in the nature of public duty, and in certain cases one of a statutory duty. It cannot be issued to compel an authority to do something against statutory provision. For example, it cannot be used to force a lower court to reject or authorize applications that have been made, but if the court refuses to rule one way or the other then a mandamus can be used to order the court to rule on the applications.

Mandamus may be a command to do an administrative action or not to take a particular action, and it is supplemented by legal rights. In the American legal system it must be a judicially enforceable and legally protected right before one suffering a grievance can ask for a mandamus. A person can be said to be aggrieved only when he is denied a legal right by someone who has a legal duty to do something and abstains from doing it.

And yes, this apply in Canadian administrative law.

Not an expert in administrative law, but when an administrative entity is supposed to take grant or deny a permit/permission/ etc. and it does neither it can be forced to make a decision that it is supposed/forced to make by law.

Not legal advice, just my quick thoughts

We could try suing in small claims for return of property. However the firearms act states I must comply to the RCMP request within a reasonable time but it doesn't state they have to examine it within a reasonable time. No time limit for them is given and since us grandfathered types are few and getting fewer nobody cares. Keep e-mailing Blaney every month but all I got was a generic letter totally unrelated to my problem . All I know is the expenses incurred are paid by the RCMP so I don't cry when they say they are under funded. It was a $300 firearm I figure they will spend about $200 in shipping and employee costs to examine it.

that is what happens when you get labeled as a terrorist, held indefinitely without the need for charges

what are the ORGS doing to help you guys with this........ seems ridiculous that stuff like this isn't front and center on social media and the agendas of groups like cssa.
it's seems plainly obvious to me on the sidelines that they have zero intention of returning your property and are abusing their power. theft might be a strong word but it certainly is appearing like that now isn't it?
