Both CSSA and NFA are highly aware of this situation. I and others have spoken with each organization's "powers that be". Both are allowing the 12X gun owners to be the sacrificial lambs. There aren't enough of us to be any influence so they are allowing us to be screwed in the effort that "their" guns don't get affected.

This whole scenario has been discussed at great length on other threads here. CSSA and NFA are letting the bad, black guns to flail in the wind. It's OK to abuse us, as long as the "hunting" crowd isn't touched.

And I have been told that directly from the CSSA. Not, "I heard this or that".

I have to stop.
 
I have a very simple solution, call the firearms centre and report your rifle stolen. Tell them you mailed it to the R.C.M.P. for inspection but you have heard nothing from the people you mailed it to and since that is the case you can only assume that it was stolen and you figured you might as well report it as such.

A dear friend of mine had one of his revolvers seized by the cops from a store, they where there to seize the stores stuff. The gun ended up at an auction place and when he called to find out why the cops were trying to sell his property he was told that he could simply go down and pick it up. He asked me what I thought and I told him that they got it there, it was their responsibility to get his property back to him, I advised him to call the constable he was talking to and tell him that his next call would be to the CFC to report that his revolver had been stolen. Within a day, a police cruiser showed up at his door with his revolver.

They have stolen your gun!! You might also want to look at the CCC and the definition of "Mischief"! and I quote:
Mischief

430. (1) Every one commits mischief who wilfully

(a) destroys or damages property;

(b) renders property dangerous, useless, inoperative or ineffective;

(c) obstructs, interrupts or interferes with the lawful use, enjoyment or operation of property; or

(d) obstructs, interrupts or interferes with any person in the lawful use, enjoyment or operation of property.

Every day that goes by is one more day they are denying you access to your legit property / the FAL. I don't care how busy they claim they are but 17 months is beyond reasonable. If they were so busy why did they ask for it at that moment and not wait until their work load was lighter? I don't know what they expect, for time, to satisfy their inspection. In 17 months they should have hired some one to do this.

Would you claim it stolen or illegal confiscation? Don't think it matters much. Where you would go with this, is a much bigger issue. That's what you have to work on I think.
 
Well I don't see how we can claim them as stoien? The firearms act gives them the authority to do this. I have complained to Blaney and my MP and they don't seem to care. You cannot make a complaint with the RCMP oversight because this does not fall in their mandate. The firearms act would have to be changed stating they have a reasonable time to complete their inspection instead of carte blanche to take their sweet time. Or a court would have to order the firearms return and impose a realistic time frame on the RCMP .

Too bad the RCMP are untouchable and the minister doesn't want to intervene. Honestly I wish you best of luck and hope this issue will get resolve soon for every one's sake.
 
The best of luck to all affected!! Sometimes I think I'm happier when I don't know all of the going ons but also realize it will be me on the block next with the restricted stuff.....
I donate already, I will have to start with letters too! Ugh, this injustice makes my head hurt.

Sounds like a judge needs to make a decision on the definition of "reasonable time frame". Speak to a lawyer and see if you can find a way of getting this before a judge. I am sure you will get plenty of donations to cover any legal costs. This definately needs to be addressed!
 
Sold my PPSH41 in August 2014. Sent it to the RCMP Ottawa lab,, in November along with the original lab report from RCMP March 1990 in Winnipeg. Still waiting. When | wrote to RCMP return Note stated basically that they have more important things to do, and the firearm is a low priority. Sounds like a make wok project to me! Thank goodness to the buyer for waiting.
 
Here's one that makes everyone's head shake:

Bought a C/A from a long-time collector, it was sent to Ottawa for about 15 months, they did some "minor" work to it, and finally sent it out. I asked for a copy of the report, but was told it was being attached to the firearm/serial number in their files.

After I had it a while priorities changed and I had to sell it. Transfer went off without a hitch and was one of the smoothest/quickest transfers I have ever had. After a couple years of sellers remorse I contacted the buyer and bought it back.

Remembering how easy the previous transfer went, and considering we live in the same province, I thought this would be just as easy. Wrong! One month, then two months. I called to check the status and was told it was being sent "for review". CPFO had approved the transfer within a couple weeks, but "the Registry" in Ottawa was holding everything up "for review".

After weeks of phone calls and emails explaining that it had already spent 15 months in Ottawa and "a copy of the report was attached to the file", everything was finally approved and the C/A on its way back to me 3 1/2 months later.

The joys of non-firearm owners being in charge of firearms.....vote Conservative for a majority.
