
And one other thing .... although being a repeater is enough to disqualify it .... it is likely chambered for one of the "no-no" cartridges, like .44-40. (Oh .... wait - that falls under the first suggestion, doesn't it!)
It could be a repeater as long as it was for a rimfire (but not .22) The Spencer for example is an antique and I presume the Henry would be as well. Also important to remember the key word is magazine as opposed to single shot; double rifles made before 1898 usually qualify for antique status

You are correct, of course. Didn't really have that in mind since, to my knowledge, the Winchester Model 1873 was never chambered for any rimfire cartridge ....
