some 40 mags are too open at the front end and the rounds will want to stove-pipe in the mag from the spring pressure. If that's the case, a slight tweak to the front lip of the mag to put just a slight hold on your cartridge may be in order. I have no idea if the HK mags are like that, but found that with some S&W mags.

I think you are missing his point, or at the very least are unaware of it. Altering the .40 magazine to make it function with a caliber other than the one it was designed to hold makes the magazine a prohibited device under Canadian law. If the magazine holds 13 rounds of 9mm and does not require any modification, then you are good to go. Once the mag is "tweaked" to function with 9mm then it is a prohibited device. Hope this helps clear things up.
