As I see it, the crown would argue that an alteration to a legal .40 cal mag may constitute manufacturing a prohibited device.
Without alteration, it's hard to argue that it's illegal.
Correct again.

Has this been discussed somewhere else that I can read? I'm pretty sure it is illegal to put more than ten rounds in a pistol mag no matter how they get (or fit) there.
Firearm act section 7
A Prohibited Device is...
Any Cartridge Magazine...
(b) that is capable of containing more than 10 cartridges of the type for which the magazine was originally designed and that is designed or manufactured for use in a semi-automatic handgun that is commonly available in Canada.
I'm quite certain that putting 9mm in unmodified .40 mags is fine.So I guess some re-working would be in order....... But that is illegal....right???
Likely not. Using G23 mags in a G19 is an exercise in frustration (lots of misfeeds), and the G23 mag lips are, I believe, identical to the G22 mags.Would a G17, for example, feed and function reliably with a G22 .40 magazine filled with 9mm?
I'm quite certain that putting 9mm in unmodified .40 mags is fine.
However, if you re-work a mag, it is no longer designed for a .40, it is a new thing that you have designed to take 9mm.
This is of course my opinion based on a plain reading of the relevant language: "(b) that is capable of containing more than 10 cartridges of the type for which the magazine was originally designed ...." Emphasis added.
This can work to our advantage: in theory, if you re-manufacture an AR15 magazine to fit in a bolt action, it would now have unlimited capacity. That's for another day; for now the reports of the function of unmodified 40mm mags with 9mm ammo are my interest.
One step back, You need to redesign an AR15 pistol to take 10 fat bullets that fill the mag. The Mags manufactured and stamped for the Ar15 pistol for the fatty .50 would be legal. Now it the .50 fatty was a center feed the mag lips may not need any modification to hold .223 rounds double stacked. Might have soem problems with the last round and the follower if you try to use it for .223 but it would not be designed for .223![]()

I like it.You need to redesign an AR15 pistol to take 10 fat bullets that fill the mag.
I like it.
.458SOCOM would do it - apparently 10 of them fit in a standard 5.56 mag, so a ten-round .458SOCOM Pistol mag would be interesting. It would need to be marked like the LAR-15 mags.
