Alberta F&W Needs Your Help!

Oh that is just foul. I hope they get caught fast.

If you're going to poach, go through the trouble of tracking down the animal you shot and actually using it.

South Edson area is a really bad one for poaching. Don't know if all those kills were just from one set of guys or a mix match from the other 100 guys that are jacklighting.

All they got to do is set up a fake deer at night and they will catch many of these ya-hoos. I am not really into entrapment but it is the only way to catch these guys it seems and I am starting to buy into it.

Talked to the fish and game officer here in whitecourt and he said the same thing is happening this year around mayerthorpe and barrhead. I really hope they catch these idiots. These people are making all hunter and firearm enthusiasts look really bad.

That's crazy! I saw an abandoned poached cow moose on the edge of a feild north of fort st John this season. Why do people do this??? Absolutley no compassion for LIFE
Shame for ALL of us to carry

How in the F is setting up a fake deer " entrapment" ??

Google "entrapment fake deer" if you don't understand.

I've looked into this several times and I'm unaware of any case that has been tossed out because it was considered entrapment.....perhaps there are some though. Part of the definition of entrapment in that the perpetrator was induced by police to break the law. Perhaps if an undercover officer talked you into to shooting a decoy you may have a point but I don't see it otherwise. Or perhaps if the decoy had record-sized antlers an argument could be made but I don't see it with a doe or cow or average bull or buck. Feel free to share some case law to the contrary.

IMO placing a fake deer is not entrapment. Tricking someone into committing an offence is different than providing an opportunity for someone to commit an offence.

en·trap·ment
noun \-mənt\

: the act of entrapping someone or something or the condition of being entrapped

: the illegal act of tricking someone into committing a crime so that the person you have tricked can be arrested

Entrapment

In criminal law, entrapment is when a law enforcement agent induces a person to commit an offense that the person would have otherwise unlikely commited.[1] It is a type of conduct that is generally frowned upon, and thus in many jurisdictions is a possible defense against criminal liability.

Poachers say a lot of things...the judge typically sees through the BS. Plus, there's typically several other charges that result....shooting from a vehicle, from a road, after legal light, etc.

You guys are more than welcome to argue what's-what on decoy deer. It gets argued every time the subject comes up.

Like I said I am beginning to come around on the idea after seeing how bad the poaching is getting around here. Seems like it is the only way to catch the true poachers hunting at night. These guys never seem to get caught at night and that's why they do it.

However! Last thing we need is a fake deer on every corner trying to trick regular guys into taking a shot then get them on some technicality like being 2 feet to close to the road or 30seconds past legal shooting according to the CO's watch. The nanny state is already out of control as it is.

I'd agree that hopefully some common sense and discretion is used by the officers utilizing the decoy.
