all of a sudden - lots of new no hunting signs

Hi All,

I'm relatively new to hunting, so wanted some feedback from the more experienced.

In mid-september I was driving around trying to get hunting permissions for November. Find it works better when I knock on doors in person rather than on phone.

I spoke with one fellow who said "sure, you can hunt on that quarter during the week, but not on weekends - that's when my son hunts"

I called this fellow on the phone last week (Oct 23 according to my notes) and asked if it was still ok to hunt on his land during weekdays - again, he said ok.

I drove by the spot today (didn't explore as today is not a weekday) and found that the fences for 6 quarters on both sides of the road, have new hand-painted no hunting and no trespassing signs. My guy's quarter also has a sign. These signs were not present in September. County ownership map says these quarters are owned by 3 separate people.

So my thought is this is either another hunter trying to disuade others from seeking hunting permissions or it is a neighboring landowner who doesn't want any hunting on his land or any of the surrounding land either.

I plan on leaving a phone message for my guy tomorrow or tuesday (I'm trying not to be a pain in his a#s) - just to make sure everything is kosher.

Anyway, thoughts? similar experiences?

how many quarters is your fellow the owner of? also is he the owner? or does he rent the land ? here in manitoba if an individual rents land, you still need permission from the owner.
 
He owns 3 quarters that I know of including this one - his name is on the county ownership map for this quarter - so I figure he owns it.

now if its posted no hunting without permision...

Perhaps the guys son went and posted it thinking to keep it exclusive..

In Ontario, written permission supercedes any signs, but must be clearly written, with lot and concessions, and signed by landowner, not his son, daughter or other relative.

Cannot speak as to the rest of the country.

I have often wondered about that. I want to hunt on my own land but don't want other people hunting on it. I too was told that if I posted No Hunting signs on my land, that even I couldn't hunt on. Seems pretty silly to me.

Did you hear that at a gun store? It sounds pretty ridiculous to me.

Read the Trespass to Property Act for your province. Ours clearly states the owner or a designate can trespass and/or partake in any otherwise prohibited activity, with the owner's written consent.

To cover that situation, make the sign say, "No Hunting without Owner's explicit permission. No phone calls or soliciting please."
 
Yeah I've heard that quite a few times before as well, that if it says "No Hunting", nobody can. But it is a myth. It just means you need permission to.

BUT, if you're going to put "No Hunting" it's good to make sure it says "No Trespassing" as well, because people may try to make an assumption that you can hike/fish/ski/what not, just not hunt.

No, but you are not the only person who believes this urban legend. Think about it - if I put a no trespassing sign on my house, does that mean that I can no longer go onto my own property? Obviously not, and the same applies to any other restrictions on my land under the Trespass to Property Act.

Along the same lines, however,
-if you do place "permissive" signs (eg. "Cross country skiing Permitted" or graphic of cross country skier inside of a green circle) then the presumption is that all other activities, such as snowmobile riding, horseback riding, hunting, etc. are prohibited,
OR
-it you place "prohibitive" signs (eg. "No Hunting" or a graphic of a hunter inside of a red circle with an oblique line drawn through the graphic) then all other activities, such as fishing, hiking, trail biking, etc., are presumed to be permitted.

From this perspective, you may want to consider using "No Trespassing" signs rather than indicating a specifically prohibited activity (i.e. No Hunting).

I have hunted plenty of private land with "No Hunting" signs posted on the land. If you have permission you are allowed, simple, is that. In the situations I am referring to, the signs are placed there to dissaude people that have the mentality that if it's not posted it's good to go...
 
Yes, I actually wrote to the MNR regarding this as an acquaintance was trying to tell mr the same story. Got a written reply, and a phone call, back that stated, "Yes, landowner, their immediate family, or any person with written landowners consent may hunt on posted property". The individual at MNR said to me. We don't own, nor pay taxes on your land so how would we be able to tell you what you may or may not do on said lands???
