Another Ontario Small Game Regulation Question

Being new to hunting and trying to cover all of my basis I was speaking on the telephone with an MNR Information Officer last week. My question was about the small game hunting regulation in an area where there is an open season for big game and the rifle restrictions for small game as per the Ontario Hunting Regulations Guide. Basically I was confirming that if I did not have a license for the big game in the area then I was not able to hunt small game with anything larger than a .22, again as per the OHRG. The Information officer asked where I lived so I told him Southern Ontario. He then told me about the Ontario Regulation 665/98 in the Fish and Wildlife Conservation Act and advised me of Section 77 of the regulation. He told me that my small game hunting is not limited to a .22 if the big game open season is for deer and restricted to bows only. He even sent me the direct link to the regulation from his MNR email when I asked for this writing. So to me it would now seem as though I would be legal to hunt Coyotes with my .243 during the Deer bow season where I live. I have never heard of this regulation before but again I am just getting in to hunting so I would appreciate to hear from others on this topic. thanks


77. (1) A person hunting small game, when in an area during an open season in the area for a species of big game, shall not possess or use,

(a) a rifle of greater muzzle energy than 400 foot-pounds; or

(b) shells loaded with ball or shot larger than number two shot. O. Reg. 49/11, s. 18.

(2) Despite clause (1) (b), a holder of a small game licence, when in an area during an open season in the area for a species of big game, may possess and use,

(a) in the case of shot made of steel, shot that is not larger than triple BBB steel shot; or

(b) in the case of shot made of bismuth, shot that is not larger than double BB bismuth shot. O. Reg. 665/98, s. 77 (2).

(3) Subsection (1) does not apply to a holder of a small game licence hunting in that part of Ontario lying south of the French and Mattawa rivers during an open season for deer that is restricted to the use of bows. O. Reg. 665/98, s. 77 (3).
 
If your hunt with your 243 during bows only season then yes - otherwise no (gun and muzzleloader week if you have one).

I think there is also another clause saying the above does not apply if you possess a deer licence.
 
Well since bow season for deer is like close to 3 months long down here. It doesn't make sense that you would be restricted to a .22 to hunt small game. I don't understand why you couldn't figure this out. It states loud and clear "Nothing larger than .22 During an open controlled Hunt season" only two weeks out the fall. And you can still hunt waterfowl with a shotgun all you want as they fall under federal regs and you don't have to wear orange to hunt waterfowl like you would to hunt small game during the controlled hunt.
