I have an old Webley #5 in 360 Rook.

That is like a very long 38S&W case - about 38Spl in length, shooting .362 lead bullets. A "magnum" 38 S&W...

It is an antique. I have the paperwork.

I have been trapping racoons trying to rip the siding off the house. Big fat ones - the size of a cocker spaniel.

I typically dispatch them with my 22 Cooey rifle. I was shooting some handloads in the Rook the other day and I got curios about how it would do on a racoon.

I live on a farm. Shooting here is legal.

Can I use an antique handgun?

I'm not a lawyer but from the research I've done regarding legal carry and discharge of an antique firearm, you're perfectly legal to shoot it on your own property. I carry my .44 Russian S&W when I bow hunt. I also have a copy of the relevant sections of the Firearms act regarding antique status pistols if the time ever comes that I'm approached by a LEO.

It’s not a firearm. Although once loaded it sort of is but it’s treated the same as non restricted. You can discharge it anywhere you can discharge a non-restricted.

You don’t need to lock it up, but being that they are worth a fortune it would be silly not to.

That looks like pretty decent velocity for an antique handgun cartridge. I actually spoke with the senior advisor to the RCMP firearms division, and he told me in front of a crowd of lawyers, that an antique handgun can be discharged anywhere it is legal to discharge a firearm. And this guy is no Brenda Lucky. He teaches firearms law within the force.

You know you've got a classic when the Wikipedia image of the cartridge is an old drawing, not a picture!

Those ballistic numbers in the chart look pretty hot for something you'd put in an antique, but they would be ballistics from a rifle. And I see the loads you're using are much less powerful.

That would be my concern - if you were running full power ammo through them - but you're using reduced loads.

As for the legality of it: I can't offer much advice or knowledge. It's well known that lots of things (BB guns, replicas) are treated as firearms when they are used in the commission of a crime (which I know does not apply to your situation). Also, while the gun is an antique (and therefore not regulated), does the status change when it is actually loaded with functional ammo? A metal pipe is simply a metal pipe, but stick a shotgun shell in it with a rudimentary firing system and you've got something that would be considered a firearm in most situations.

There are specific storage and transportation laws for antiques. They are considered firearms, according to the firearms act. And given that it is considered a firearm, the discharge laws for firearms apply. But if you can legally discharge a non-restricted, you can also discharge an antique.

Instead of paraphrasing, here's a link to the relevant section of the actual firearms act:

IIRC hunting raccoons in Ontario at night must be done with a rimfire and a specially licensed dog so be sure to mention the property defense part if questions are asked.
[h=3]Hunt raccoon at night[/h]If you wish to hunt raccoons at night, you must be accompanied by a dog licensed for the purposes of hunting. Each dog participating in the hunt must be licensed. You can only use a rim-fire rifle. Raccoon night hunters must have their guns unloaded and encased while in a vehicle. A licensed night raccoon hunter may use a light if it is not shone from or attached to a vehicle or boat. Learn more at hunt raccoon at night.

I’m pretty SURPRISED the Libby Dictatorship have not put the STOP “ owning and using “ on antiques especially the handguns ? RJ

HUSH YOUR MOUTH!!! All we need is some Libtard troll seeing something like this and waking up to the fact that there are thousands of functioning handguns out there of which no record exists unless you went through the process of acquiring the FRT letter from the Mounties.

Yes, it is a solid frame gun, unlike some of the other old guns. I like the 2.2g of 231 under the hollow base wadcutter, in 38S&W brass because that is my accuracy load for my 38S&Ws. I crank them out by the bucket in my Dillon.

If I want more velocity at the same max pressure, I use a 38Spl case.

So if I can use a 22 rifle - i can use this antique. Good to know.

Slightly off topic, apologies for that, but what shell plate are you using to load 38 S&W in your dillon? I have a buddy that has an old revolver in .38 S&W, and he asked me if I could load for it with my 650, but I wasn't able to find out what shell plate would work.

According to wiki, rim diameter is the same for both 38 S&W and 38 Special, and rim thickness is very close. I'd assume the same shell plate you'd use for 38SP / 357Mag would work.

I read that the .38/.357 shell plates won't work for that reason. I never had a .38 S&W case to try though, to be fair.

This is the correct answer. Pretend it's a NR for where you can shoot purposes.
