Antique status question

I found the chart a little confusing,

My Uncle has a Marlin Safety Lever gun in 44-40, Made in 1889, Does it qualify for antique status?

Unless they are rimfire.

Doesn't matter the type of magazine, if it's a repeater and centerfire it's registered.

Whats the worth of this rifle? Its in fairly good shape other than the little spring that holds the lever tight agasint the stock it broken, Bluing is probably around 60% maybe more, Rifling is decent,
