Approval pending traffic ticket?

So I got a call from who I'm assuming is someone at the CFO office. About to approve my RPAL, then she informs me that I can't because I have "an outstanding warrant for my arrest" for a traffic offense that is currently awaiting trial. My lawyer assures me that it was not forgotten about and addressed at the original court date addressed on the ticket, and also said that it was bogus they were holding my RPAL back because it's a traffic offense. Any thoughts or advice would be nice.
 
Yes I understand and know the difference. It is awaiting trial, but the woman on the phone said outstanding warrant. I don't think it's a warrant personally. With that being said, the offense itself was fleeing the scene of an accident. I know it sounds bad, and I wont dive into it being a legal matter and whatnot.
 
Weird that they would call you to inform you of the delay,or did this come up during your interview? Fleeing is considered srious, but is only an HTA offence, unless there are other charges pending, which could be what the warrant is about.
 
No this came up post-interview, they were doing my background check and she said I was going to get approved, but this is preventing it. The thing is I got other tickets issued along with this one at the same time, and there wasn't any mention of them.

Did you get charged criminally or are you sure it is only a ticket for failing to stop / remain etc?

No charges as my lawyer made a trial date for the offense, appeared in court for me on day marked on the ticket. Had 3 other tickets along with this one.
 
I would suggest contacting the local court or police agency to find out if there is an outstanding warrant. I have dealt with numerous people wanted on warrants that claim they have attended all their court dates or whose lawyer dealt with all their issues. All that matters is a piece of paper signed by a justice or judge. It's better to resolve it on a week day and get it over with than get picked up in the evening or worse during the weekend and sit around jail for longer.

Failure to stop at scene of accident - Criminal Code of Canada section 252
252. (1) Every person commits an offence who has the care, charge or control of a vehicle, vessel or aircraft that is involved in an accident with

(a) another person,

(b) a vehicle, vessel or aircraft, or

(c) in the case of a vehicle, cattle in the charge of another person,

and with intent to escape civil or criminal liability fails to stop the vehicle, vessel or, if possible, the aircraft, give his or her name and address and, where any person has been injured or appears to require assistance, offer assistance.




I'm sure every province has the same offence in their motor vehicle act. Some muncipalities also duplicate all the provincial offences in their bylaws.




Warrants for traffic tickets?

As an example BC used to issue warrants for unpaid motor vehicle act tickets. However, now the fines are collected when you renew your driver's licence or car insurance. Not every province is set up this way.

Traffic Bench Warrants are still issued for unpaid bylaw tickets in BC. I have seen them for as low as $50 (which is ridiculously low) and the highest I've seen is for $3000 (lot of unpaid parking tickets).
 
Thanks homer76 and everyone else, I will update when I iron this all out. Hopefully this doesn't hold me back from obtaining my RPAL, wish me luck.
 
Of course, since it still does not meet the criteria of an act of violence against person or property, it is still bogus to hod up the RPAL. Even if it is a CCC offense, and the OP is found guilty, he can still get his RPAL.

Talked to my lawyer, called the very nice lady who called me on Friday and I am approved. Everything is aces and will be shooting soon! Thanks to everyone for their input & happy shooting!
