ATT's what you need to know

First time restricted owner here, in the process of acquiring first pistol. The item is currently residing at the seller's place, and it sounds like the CFO is going to want me to submit evidence of club membership before they will approve the ATT to get it to me.

I'd rather like to kick them in the teeth over this, seeing as I need do nothing of the sort. Any recommended reading or advice for the coming fight?

They might.. but remember.. membership is not required by law.. and if they try the "membership" BS remind them they are over stepping their authority and they MUST either do the xfer or refuse such in writing (which they won't want to do of course)

Oh and I had my restricted firearms w/o a membership and I know many others that do as well.

This is a private purchase? I believe that is your problem and why they are being anal about the membership......I went to a range to by my first hand gun, I registered for the range and bought a gun in the same day. They got my ATT in like 4 days, and Im not even a full member yet as I just reg that day....

Now I just bought my 2nd pistol on Friday, I got to the store at 7pm, so I was able to buy the gun, but had to wait till monday for them to get my ATT. They left me a message at noon on Monday to let me know my ATT was ready...So they got me an ATT within a few hours on Monday...I asked the guy how it was so fast, and he says they have a good relationship with the CFO, and because they do so much business their requests go through faster with less problems...

And I believe there is no actual law stating that you have to be a member of range or club, when I bought the gun on Friday the store handed me a paper with legal requirements on it...At the bottom it said something along the lines that if you are not already a member of a gun club or range, that you intend to apply for one in the near future...

I do have a range membership and all, but any chance to get the boot in against the RCMP is time well spent, IMHO.

Section 28(b) of the Firearms Act states:

28. A chief firearms officer may approve the transfer to an individual of a restricted firearm or a handgun referred to in subsection 12(6.1) (pre-December 1, 1998 handguns) only if the chief firearms officer is satisfied

(b) that the purpose for which the individual wishes to acquire the restricted firearm or handgun is

(i) for use in target practice, or a target shooting competition, under conditions specified in an authorization to transport or under the auspices of a shooting club or shooting range that is approved under section 29, or

(ii) to form part of a gun collection of the individual, in the case of an individual who satisfies the criteria described in section 30

and Section 67 of the Act states:

67 (1) A chief firearms officer may renew a licence, authorization to carry or authorization to transport in the prescribed manner.

(2) On renewing a licence authorizing an individual to possess restricted firearms or handguns referred to in subsection 12 (6.1) (pre-December 1, 1998 handguns) a chief firearms officer shall decide whether any of those firearms or handguns that the individual possess are being used for a purpose described in section 28.

I have to say, while it is murky, the whole 'only if the CFO is satisfied' remark is standing out quite prominently. There is no real qualification in the statute as to just what a CFO requires in order to be satisfied, so it can be considered that any policies they have are what is needed.

Somedays I hate having gone to law school. I was rather looking forward to putting the boots in.

Call them back.. and insist on their either issuing it NOW.. as is required by law.. or issuing the written refusal NOW.. as is required by law.. Anything else is over stepping their authority as per the FA.

There is no 'a few days" crap (other than the fact they will print it and send it by can-par as a rule which is usually the next day)

Indeed.. but your having a membership or not is irrelevant to the actual law.. and "policy" is NOT law. :)

Sorry but no.. that does not give the CFO that authority.. as has been proven in court multiple times.. remind them of that including wyatt being forced to admit such on the stand multiple times.. then restate your request that they either issue the ATT or the written refusal (btw quoting that section of the law to you is them trying to dodge the question.. and thereby not issuing any refusal... call them on it)



PS: You can also point out that the ATT is going the way of the Dodo very soon... thanks to some of us fighting back against their constant BULL####.. so fighting you on this is only going to cost them $.. and look bad as you CC everything to Blaney and Harper.
 
Read the first 5 and last 20 or so pages but getting sore eyes here, anyone know if the LTATT in SK can still be applied for all ranges in western provinces and us border crossings? Anything else i'm missing besides requesting 5 years / pal expiry.

Complete BS. Its now up to the AB CFO to allow the transfer or not. I did take a pic of my range membership and emailed it with the transfer #, now its the waiting game. Hopefully I can take possession of the pistol, then apply for a LTATT and if refused I'm going to fight it anyway I can. Already talked to my MP and writing letters to numerous MP's and the PM.
The CFO's making this crap up is unacceptable.
 
Strange as it may sound, My LTATT arrived well before any of my pistols or transfer notifications showed up. It was email to me, Applicable to all ranges and border crossings in AB. Guess I got lucky

As others have said, I read the first 4-5 pages and several of the later/last ones; it seems things change and are hit or miss.
Here's my situation.

I moved from NFLD to AB a few months ago. I have my PAL and RPAL and my club membership for the rod and gun club in NFLD. I have not yet purchased or own any restricted (or non-restricted) firearms. My PAL's will expire in the new year Feb/March I think, so it's crunch time(?) as I've heard there can be troubles upon renewal request for RPAL if you haven't used your first 5 year term to purchase a restricted.
Any questions I have are regarding the most "un-gimped" (lol), most freedom oriented ATT's (I'm not sure what the extra letter versions of this acronym are for; LATT LSATT)
Anyways,

I'd like to know what is the most recent version of what to do and how to do it, where to do it; if there's a specific person/office/CFO to call? Do I need to be a member of a "local" club here in AB to either; purchase a handgun, or just to get an att? The one gun store I visited months ago in Edmonton, MilArm, said when I asked what I need in order to buy a handgun was "give me money" as he put his hand out. I guess to show me how effortless it would be.

I'm kinda confused here, to say the least. I mean I could use some help/guidance like the steps to take (like OP laid out, only updated I guess) to get the best (most freedom) situation with owning and be allowed to transport my first restricted firearm please :)

I've been waiting so long and I can't wait to get to a range and have some fun.

i just signed up to my local range a week ago. gotta wait 6-8 weeks until my turn to take the club level safety course then do three probationary shoots before i can get my full membership... but i bought a M&P22 (been in my possession for a few weeks now). i also just purchased a 1911 the day after i signed up to the club. my father also just transferred his old S&W 14-3 SA to my name. ive had no issues so i dont understand why they are giving you the run-around. i hope everything works out for you.
 
im about to renew my att in BC, i want a general att with all the goodies described in the first page.

can anyone give me a recent experience on the "ask for written refusal" routine? I want to give it a try, but armed with the latest and greatest info.

You've got to wait 6-8 weeks just for the club level course, holy #### that's bad.
 
Well attempted to get in touch with the BC CFO. Spent 22 minutes on hold ( 778-571-3400) before I gave up, then i called the 1-800 number for Canada wide CFOs... on hold for 12 minutes there before i gave up

Anyone have a better contact number, or easier way to contact the BC CFO?

I've had great luck phoning in the morning before heading to work. BC CFO opens at 8:30am. You'll usually wait a few minutes and be through.

On with the drama;
So finally got through to the CFO office. Had some chit chat with someone who worked there, very pleasant conversation. A CFO will be calling me back.

Some interesting interactions from the conversation:
Q: My ATT expires in a few months, how do I renew it?
A: Send proof of your Gun Club membership by fax to 1-888-895-9955 or email it to CFPCFOUNIT@rcmp-grc.gc.ca
But I read something different here:

Q: My understanding is that the CFA does not allow for a membership as a requirement for an ATT
A: Thats the way it is. Deal with it.
Q: Which part of the CFA says I must have a membership?
A: 55. (1) A chief firearms officer or the Registrar may require an applicant for a licence or authorization to submit such information, in addition to that included in the application, as may reasonably be regarded as relevant for the purpose of determining whether the applicant is eligible to hold the licence or authorization.
^ This is one of the reasons "a Firearms Officer" will be calling me back.

Further down the rabbit hole:
Q: What if I don't want to pay for a membership at one club because I'll be shooting at several and will pay one time usage fees?
A: Not allowed. You must provide the shooting club membership proof to get an ATT
OK I'll one up you:
Q: I'm going to take my black badge and start shooting IPSC. Clearly I am a target shooter and actively involved in the sport, so no single range membership is necessary, correct?
A: No. If you want to attend IPSC matches you have to provide a list of each match and get temporary ATTs for them.
Q: But doesn't the fact that I actively participate in target shooting sports clearly how that I need to go to other ranges? Isn't that better than just having a single range membership?
A: No. You have to provide the following:
1.) Your range membership to get a long term (LT)ATT
2.) Your IPSC membership AND your list of events to get specific short term ATTs to those events
^ I was just left confused and bewildered after this exchange. It seems like the more questions you ask the more complicated it becomes. There are no straight answers. Very frustrating. My take away from this was that I can get a LTATT for BC with a membership to a range, but to actually shoot IPSC events I have to provide my membership AND my IPSC card AND a list of events to get a short term ATT to go to the events. very confusing, indeed.

Moar:
Q: My residence is in Cit X, I often stay in City Y and plan to do some shooting at the range in City Y. Am I allowed to go to City Y for a few days visit and attend the range in city Y?
A: Yes.
Q: What if I while im there I stay with my restricted firearm at friends/familys' house- Even if I am NoT shooting every day? Could I stay there for 10 days?
A: Yes. This is covered in your ATT
Q: Well the wording seems kind of vague and open to interpretation. How can I be sure I am following my ATT within the law?
A: Get another short term ATT

... Ugh. So basically the answer to everything is get another ATT. :(

Well obviously I want to change my ATT and add my friends residence where I often stay:
Q: Can I add another residence on my TO and RETURN TO portions of my ATT?
A: Yes of course. If you can prove that you are the OWNer of a second property, we can update your ATT for the second residence
Q: What if I often stay with friends in City Y?
A: No. Then you have to prove that you reside there
^I gave up easy on this line of questioning. Anyone know what part of the CFA references a second residence on ATT? Do I really have to be the OWNER? What If I rent two houses? Or stay at a friends? Again, the answer... get another ATT. :(

Q: Can I borrow a restricted firearm from a friend? Will my ATT cover me for Restricted firearms that aren't registered to me?
A: Yes, you just need to have the certificate with the firearm and something written from the registered owner saying I can use it, as the certificate will have their name on it
^ WOW! That actually sounds easy and common sense, I had to clarify that... and then like a bad dream, the answer morphed into something more onerous:
Q: So I can go to my friends house and pick up his restricted firearm and take it to the range, as long as he writes me a permission slip and I have the certificate?
A: No.
1.) First your friend has to call the CFO and let us know that he's loaning out the firearm.
2.) Then a temporary ATT will be issued so you can transport the firearm to your home.
3.) Once its at your home, then your current ATT which only covers return trips FROM: My Residence only TO: Boarder crossings, ranges, gunsmiths RETURN TO: My Residence Only can be used.
4.) You must get another temporary ATT to return the restricted firearm to his house.
So I followed up with an obvious workaround:
Q: I'm good to transport to and from ranges & gunsmiths, so can my friend drop off his restricted firearm at a gunsmith or range, then I pick it up there?
A: No. Your LTATT covers return trips only. it must go From, To, and Return to. You are not authorized to pick a gun up at the range/gunsmith and bring it home unless you first delivered it there from your residence.
Checked the wording on my ATT:
FROM: My Residence Only
TO: Ranges, Gunsmiths, Border Corssings
RETURN TO: Mr Residence Only


OK, so logically I want to change my ATT
Q: Can I change my ATT on the FROM and RETURN TO sections to also include "Ranges, Border Crossings, and Gunsmiths"?
A: Thats up to the CFO


So "a Firearms Officer" will be calling me back. I'm going to attempt to fight the good fight in a respectful and knowledgeable way.

I would like my next LTATT to Read:
FROM: Any Gunsmith, Border Crossing, Range, My Residence, OR Any Other Registered Residence or Business that legally stores restricted firearms
TO: Any Gunsmith, Border Crossing, Range, My Residence, OR Any Other Registered Residence or Business that legally stores restricted firearms
RETURN TO: Not required.
FREQUENCY: Daily
TIMES: 00:00 to 00:00

Bump on this thread as things change in Ontario.
I am planning on buying a single six ruger from Cabelas in Barrie.
Also considering the uberti SAA from marstar which is online.
How do I proceed?
I belong to 2 different clubs but have not taken the handgun safety courses yet as I have only rifles. Also I have had my restricted license from the beginning last year when I got both.
